You make my head hurt. ;) It's probably different cos it's about music not literature, but John Fogerty won the case against his record company, who sued him for plagiarising himself, and thus infringing on their copyright. Never fails to boggle me, that.

Warning: I have never had work sold officially to an editor.

But from what I do know of the industry, it depends on what the conditions of the first publisher were. There are some publications contracts where you're selling them the rights to run it once, and then the rights revert back to you anyway and you can do what you want with it again. It all depends on the publications deal you entered into with the first publisher.
