Part of me doesn't want to believe that those people can be so deluded. I mean, they lose initially and by withdrawing the appeal they imply that they think they'll lose again and yet these idiots are celebrating like they won and stuck it to 'em?

I must say I had a good laugh looking at SIP's website. She's decided this is a victory for RDR Books and SVA. Hmmmm. Curious. RDR loses the lawsuit, drops the appeal, and will publish a completely rewritten companion book bearing the title Lexicon in the hopes of paying down its huge legal bills, and it's somehow a Win for SVA? I must be missing something.

Lose the case on all counts; Plunk down $450 for filing a notice of a appeal that will never be because they conceded defeat and rewrote the blamed thing (as they should have done ages and ages ago) so that it doesn't blatantly plagiphrase or slavishly copy JKs intellectual property; yet somehow that is a 'win'?

How could anyone with call this a victory for RDR? What did they win?

This is a victory for JK Rowling as she won in a number of areas. An infringing book was never published and her intellectual property was protected. The world now knows the lengths she will go to protect her property. I think it will be some time before someone else tries this.

Steve Vander Ark and RDR are finally doing something they could have done on October 30, 2007, print a non-infringing book. It would have saved an incredible amount of time and effort. And as a bonus, we would have never even known there was a problem. This was a mess they brought on themselves through many miscalculations. A win for them, I do not thing so.

Yeah, those people at Leaky gotten to the heart of the matter pretty clearly. I am honestly just completely boggled at the power of wishful thinking from the rabid SVA/RDR fans though. I don't just say that. I'm sitting here shaking my head in stunned amazement. Them sitting over there gloating in delusional vindication and mocking those who supported the ~actual~ winners just... it makes my head hurt because it makes no fucking sense.

Yes, a Lexicon book will come out, so I suppose in one sense they and SVA/RDR get what they always wanted, but c'mon now. They can spin it how they want, but the Lexicon came out by far the worse for this little fracas. For as much additional publicity outside the main fandom that they generated through this trial, you can bet that they soured a lot more of the core HP fanbase that would have been more inclined to buy the published Lexicon in the first place.

Wow, good old Roger Rapoport must have finally exorcized Lawrence Lessig and sent him howling back to Stanford! This is clearly what's in RDR's best interests at this point, not being someone else's ideological guinea pig, and I'm glad they figured that out.

Odds the book actually gets rewritten and released? And if RDR tells SVA he's got to redo it, does Steve have a choice in the matter?

Depends on what's in their contract. Common sense says no, but the RDR train is pulling into Denver, while common sense is still black on the platform in Lincoln with its wheelie bag, saying, "Guys? Guys...?" and fending off hobos.

Ah, so that second one is the one that Rowling made the comment about. Huh. Still wouldn't buy either one of them.

I LOVE this part of the first article, though:

"We think it's a better book in many ways because it has a lot more analysis," said Roger D. Rapaport of Muskegon, whose RDR Books is publishing The Lexicon. "He's done an amazing amount of new work."

No kidding. Really? The book's better for having more analysis and new work? You don't say.

And they wonder why WB and JKR went after them.

I am kind of annoyed that the articles seem to say that Rowling's main problem with the book was that it would take market away from her planned encyclopedia of Harry Potter. Which I don't remember her ever saying except maybe as a side note.
