I would be willing to bet three shiny quarters that 99% of the people there starting threads going "but but but they got no SEVERANCE" had no fucking idea what the word severance even meant before hearing it as related to the layoffs.

(Two handy pieces of info: one, Cali is an at-will employment state, thus no notice is required; two, only companies with over 100 employees are required by law to give severance in Cali. But I know, I know, expecting people to actually look up the law or something is liek soooo mean!)

All my techie Bay Area jobs had gave two weeks notice/ semi-severance. You could go in and finish up, but they took away all your interesting passwords.

No shit, sherlock. But have you read the post in question? Point to me where people are in any way cognizant of the legal background and are making solely moral/ethical arguments with that awareness, and I'll give you those shiny quarters.

In a just world, we'd all get severance and notice. In an at-will state like California, in the middle of a recession that's hitting the tech sector especially hard, being allowed to finish out the week is, sadly, pretty decent.

Have you read the post? It's full of people leaping to wild conclusions that since LJ didn't give severance/notice, they must be omg going out of business right now and/or people are saying they must have broken the law somehow.

I, too, think no severance or notice is shitty behaviour, but that doesn't equal LJ having done anything actually wrong by not doing it. The number of people in that post who are upset because it seems shitty but also understand that LJ didn't actually do anything wrong is extremely, vanishingly, small. And it pisses me off, 'k?

I read the first three pages. What I saw was a bunch of people protesting shitty behavior, and another bunch of people going "LOL MORONS IT'S TOTALLY LEGAL," because they totally missed the point.

LJ having done anything actually wrong by not doing it.

IT DOESN'T HAVE TO BE ILLEGAL TO BE WRONG.

That might be because you seem to have defined anyone who disagrees with LJ's actions as, one, not understanding that legality and ethicality don't necessarily coincide, and two, anti-Russian. As if everyone would have cheered the layoffs if Six Apart had done them, or something.

In what world is "shitty behaviour" not "actually wrong"? Sure, illegal is one thing, but firing someone without notice or severance, especially when you could afford it (not saying they could, but just saying), is actually wrong.

Thank god. I was starting to feel like all the sane people hadn't seen the post. I'm even talking on the post - before it ever made here - and I don't care if it's legal or not. It's just shitty behavior, especially after the "valued" comment. Okay, they can't afford to pay a lot, so give $200. Just something to back up the words they spoke (or wrote). Quite simple, really.

And all that's getting lost in the fuckwits that think it's the latest ONTD post or something.

Yeah, what's up with that? It just seems like they're so anxious to shout everyone down. I'm not screaming "OMG KONSPIRACEE!" so much as I'm wondering why they're acting like kids hopped up on pixie sticks in front of the whack-a-mole station at Chuckee Cheese. Is someone assigning points for "winning" that argument? If so, should I just start jumping in before it winds up on FW, so I won't be accused of trolling the wank?

Hell, Texas is an "at-will" state, and I got severance when I was laid off my tech job during the mini-recession of '03.

Indeed, even if you're in an "at-will" state, not being given 2 weeks notice is still considered douchey, unless there's a really good reason. Sure, everything goes flying out the window when the company goes Chapter 11, but that's another thing entirely.

You'd lose that bet with me. I know what it is and have nearly all my life. My dad works in a box factory and part of why I feel sorry for the laid off employees is because I would have the same reaction for my family. A family that is made up of non-union factory jobs.

In fact, my aunt was laid off from her job while on sick leave (one of the employees purposely shined a laser in her eye on the line) at a lighting factory because they moved it to Mexico without even a month's warning. She got a severance package. Not a big one, but it helped while she got unemployment and looked for another job in factory work. The new job fired her for having the audacity to end up with cancer, thus taking away her insurance midway through chemo, after working there a good five years. She had to live off the government for the next year of her life in order to live, and she lost the battle to cancer after that year. She obviously didn't get a package from that firing.

See, it's stuff like this that makes me think the people like the one who made the comment you referenced have never left the comforts of Mom's basement. Nor do they have any concept of what Mom does for 8-10 hours a day to keep that basement over their heads.

Gah, I'm seriously starting to splooge everywhere about this now, but it bugs me.

I grew up knowing that my dad's job could be yanked. He's worked in 2 box plants since I've been alive. He joined the current one when I was in my toddler years and he hit salary after about 3 years. Before that it was a guessing game how much he was bringing home. My mom was fired from all her factory jobs for being stupid (hint: don't show up to work still drunk and wearing your party clothes) so it was worry how much we'd manage without a consistent job. Hell, he's the first shift manager and still I worry.

My aunt was in her mid-to-late 50s when the last one fired her. I have an uncle working in one and another that depends on running cable wire through new buildings. With this economy, no one can really help them, especially in the family. I worry about them all the time since getting a job in this economy is harder than it has been in a long while. And they're not trained to work in things like office work. They depend on manual labor. Bit of a standstill at the moment.

There's no way in hell I've got time to set it up, but if someone wanted to set up a "give LJ employees the severance pay their company is too crappy to give them" I'll happily toss in five dollars. (Hell, if everyone on there complaining tossed in a couple, that'd add up to pretty decent severance pay.)
