feds bust stargate fan for running bitchin' website
Stargate Fansite Promotes Show for Free, Inspires $100,000+ in DVD Sales, Attracts Praise from Show Cast and Crew, Gets Busted by FBI.

...perhaps most disturbing of all, it was later revealed that the FBI invoked a provision of the USA Patriot Act to obtain financial records from his ISP. The FBI's abuse of its powers did not stop there. When they seized Adam's computer equipment, he was given written documentation stating that it would be returned within 60 days. The equipment that they did return did not arrive until more than 8 months later, and only then after much prodding from his lawyer. Much of it was damaged beyond repair - one laptop had a shattered LCD screen, an empty tape backup drive was ripped apart for no apparent reason, his fiancee's iBook was badly damaged when it was pried apart with a screwdriver. The FBI's computer crimes staff is either incompetent (at least when it comes to Macintosh computer equipment) or else they just don't give a damn.

There's some discussion about what was actually up, and how long the eps were there, in my LJ in the comments.

Hm. Yeah. I just read the press release from the DA's office, too. Frankly, I'm surprised it hasn't happened before to someone offering episodes for download--and especially someone who kept on *after* getting a C&D. It's not that I don't think it sucks that he got arrested for, essentially, helping put money into MGM's pocket (though I gather it was the MPAA, not MGM, that had the beef with his site), but at the same time it wasn't like he wasn't warned that a Power On High was taking official and legal notice of what he was doing and might, you know, follow up if he kept on doing it.

I remember sg1archive.com having the entire series available for download as 30mb wmv/avi files for quite a long time, certainly a couple of years, until they got hit with a cease and desist a couple of years ago. So it's not quite the poor innocent fan website smackdown it seems. Although the quality of the videos was terrible, or so I hear. *cough*

*.asf files, badly compressed 320 pixel res, complete seasons 1-5 - to be precise... Not that I like know or have ever known or accidentally let my mouse slip and download any... ever. *cough*

Oh, he definately had most, if not all, of the series up for download at one point. I remember being puzzled that the site was so public, considering that, bad quality or not, he was offering full episodes.

...and also, hrmm. I notice that after some people in the comments section said "Hey, look. He DID have full episodes up for download. Check archive.org if you don't believe us", archive.org is now denied access to the site. Very convenient.

Well I feel safer. And patriotic. And while I'm at it I'd like to note: I am not now, nor have I ever been, a member of the Fannish Community.

Department of Justice press release

So while it's a bit harsh, dude, he did have all those episodes on the site. You're gonna get your ass kicked eventually, no matter how much corporate cock you've sucked.

The stars can love you, the writers can love you, the producers can love you, but in the end, legally that doesn't mean jack if corporate - the entity that actually owns the show - decides they need to make an example.

Remember when U2's record label sued whatever group it was that sampled and parodied one of their songs? U2 actually liked the work, and tried to intervene. Didn't do a bit of good.

moved his website overseas and continued to stream episodes over the Internet until April 2003

Ouch. That's not what the Archive site has been saying. If that is what they were up to, they're so busted.

the FBI invoked a provision of the USA Patriot Act

Regardless of guilt, if this part is true, it is so wrong on so many levels.

A fellow Stargate fan posted this in her journal. The original post is locked because she posted her PayPal receipts with personal information, but she invited us to spread the word if we wished, and I thought it might be enlightening:

If you're thinking of sending Adam McGaughey money for his legal bills, please reconsider and don't. He still owes me a DVD player I purchased through his site almost three years ago that I never received. Because I'd downloaded episodes from his site, I thought it would be a kindly gesture to buy something from him. I won't make that mistake again. :P

[snip receipts]

I can't find the email where he told me that the reason I hadn't received my DVD player was that his supplier was located in the World Trade Center and was therefore blown up on 9/11, nor do I apparently have the scifi.com chat log from the first abortive attempt at a Michael Shanks chat where I cornered him and he denied being Adam McGaughey and claimed that he'd purchased the domain from his friend and would talk to him for me. I'm sure his claims of being oppressed by the PATRIOT Act and the evil MPAA are every bit as truthful as the things he told me. :P

I am further not the only person who did not receive their DVD player. He ripped off [another fan], too. I realized I'd been had fairly quickly, but not quickly enough. I complained to paypal, but they said that since it had been more than 30 days I was SOL.

Please, do not waste your money on Adam. And feel free to spread the word if so inclined.

I'm becoming less and less surprised that this guy was arrested...
