Fanfiction, it's like stealing little old ladies' purses in a way.

Godd I can't believe my friend's mom knows him (and his brother) personally. And well. I feel sort of dirty being one step away from that giant ball of crazy. I'm glad it's not contagious.

There is not a published philosopher who will tell you that a copy or derivative work takes away from the aesthetics of the original. The aesthetics of an original work of art are completely independent of what people say or do about it.

Art is defined by a number of factors, depending on who you ask. A formalist view would state that it's only the form of a piece that defines its artistic quality, taking into account nothing around it. You begin and end with work of art itself. Does fanfic encroach on this? No. It is judged on its own merits, so the formalists don't think fanfic would affect the original.

The other prevalent view, the contextualist view, takes into account the formation of the work of art. Historical context, cultural roles, moral quality, artist intent, and such. But it does not take into account critical reviews, how the art was accepted at the time, or, for instance, what the fandom had to say about it. It's like there's a terminating line of context once the work of art is finished. Once again, fanfic has no bearing on the original work.

Of course, as is true with most philosophy, both extremes fall short. But even in a hybrid view, we can easily see that no harm is done to the original. What the "fake" fanfiction does, since we know it is not the same as the original, is help us distinguish what is distinctive about the original artist's work, so that we may better appreciate it and recognize it when we see it. In this case, fanfiction could be said to almost increase the aesthetic value of the original, or at least our appreciation of it.

In short, the original comment in italics is a load of crap.

I know. Fellowship of the Ring was great, but the sequels had no artistic merit whatsoever. I felt so let down in volume II and III when this Tolkien hack assumed that I already know what a Hobbit is. A real author would never be this lazy.

I want to see the day OTW legally challenges J.D. Rowling's right to prevent people from disseminating stories about Snape and Voldemort gang-banging Harry Potter and Ron.

I only know this guy's name from seeing it pop up on my JF flist from time to time. I usually don't click on the wank since I have no idea who he is and why I would care about him. Anyway, nice "typo" there Lee. I'd call it a legitimate error if the 'K' were anywhere close to the 'D' but the fact that both letters appear in the same row doesn't cut it.

I doubt after all this time we'll see Jo do a 180º and tell people not to write fanfic using her characters. Would she want to read a story about Snape and Voldy gang-banging anyone? No, but she *knows* it's out there just as she knows that somewhere in fandom there is a fic about Madam Hooch shagging some other character from her universe. I enjoyed hearing her mention fanfic in the Pottercast interview yesterday, especially when it was in reference to Madam Hooch of all characters. :p

So if you're writing a series of books, and by the ninth volume you start to assume the readers know who the characters are by now and stop re-introducing them as if they were brand new, your book sucks? Every Star Trek novel has to treat the reader as if they have no clue who Spock is? Every new Diagnosis: Murder masterpiece has to pretend we don't already know every little thing about that guy played by Scott Baio?

Okay, I confess, I had to look up who the hell was in Diagnosis: Murder. Wow, Scott Baio?

The OTW claims that "fannish work," an umbrella term for fanfiction and the "Real People Slash" that Dr. Reid gets off on and even such fetish fanfic as "DUE SOUTH Masturation" stories, is "transformative" rather than "derivative," that it is a unique and important expression of feminism, and therefore should be legally protected.

Due South Masturbation stories... that is the worst fetish you can think of? Come ON. I know Diagnosis murder taxed your imagination, but where is the tentacle rape? The D/s? The YAOI? Do you have no thoughts on yaoi?

In typical fan fiction there is not even a physical description of the characters.

So Lee is the kind of writer who thinks physical descriptions are required? Now his lack of worldwide success, lionization, and a Nobel Prize for Literature start to make sense...

What's most frustrating about Lee Goldberg is that he misses a very salient point, one taught in basic, first-year writing, journalism, publishing and communication courses. It's called death of the author.

After a thing is written, the person who wrote it has no further control over it. You can control where it's published and by whom, and you can stop other people from copying it and profiting from it, but that's just the hardcopy. The text. You cannot control who reads it, what they they think about it, what they say about it, what they write about it. For all intents and purposes, the author's contribution is over and done with.

This doesn't mean that other people can step in and take over in terms of profit, but you sure as hell can't stop them from writing whatever the hell they want about it.
