Just a quick update
Watch That Page reports some updates to the RDR Books site:

THANK YOU FOR THE MANY EXPRESSIONS OF SUPPORT FOR OUR AUTHOR STEVE VANDER ARK AND HIS HARRY POTTER LEXICON.  The preliminary injunction case will be heard February 28 by New York Federal District Judge Robert Patterson. More information on the Harry Potter Lexicon lawsuit is available here.

Unlike a Potter film or computer game, the authors of the Lexicon encyclopedia are not simply moving Potter to another medium. Their purpose, rather, is providing a reference guide with description and discussion, rather like a very long and detailed book review. Such guides have been around forever—centuries if you count the Bible, and more recently for complex works like the writings of Jorge Borges or The Lord of the Rings. As long as a guide does not copy the original work verbatim, it falls outside the category of "adaptation." And that's why it is largely unnecessary to discuss the more complex copyright doctrine of "fair use." Rowling's rights over the guide don't exist to begin with, so we don't need to go there. (bold mine)

So does this mean they ARE using the essays up on the Lexicon in the book? Have they confirmed yet whether the authors of those essays have been contacted about the use? Or are they saying that publication on the website essentially releases the essay authors from all rights?

I'm not sure I understand where the focus of the trouble really is. Is it Rowling vs the Lexicon (in which case yeah, if there was a problem with the concept then all those other sf&f &c. compendia would be in trouble), or Rowling vs Publisher (who didn't ask her first?), or Publisher vs Uncredited (and unasked) Essay Writers. Help, anyone?

It would, by necessity, give copyright owners power over the content of Wikipedia and other online encyclopedias that discuss their works. Not the end of the world, but certainly a subtle form of thought control.

I knew it all along! JKR is trying to control our thoughts first with her book, then forcing us all to think as our corporate masters do!

And forgive me if I'm wrong, but an encyclopedia does not constitute discussion. An encyclopedia constitutes a listing of facts derived directly from, and consisting only of material found in the copyrighted books. Discussion is found in books like Harry Potter and Philosophy, in which real-life philosophers discuss the implications of the story. Or, similarly, I recently saw a book called The Psychology of Joss Whedon. Oh, and my personal favourite (and a pretty good read), Star Wars on Trial. All presuppose knowledge you might gain from an encyclopedia, and then they talk about it. Discuss, as it were.

Oh wait. I'm using Earth Logic again. Sorry, I keep forgetting...

No matter what name you characterize the "thing" with, its original concept is already preexisting. Should Wiccans be allowed to sue her for wrongly portraying "witches and wizards". They've been around a lot longer the "Harry Potter", so therefore should maintain all creative rights to the concepts created which lead to magic, witchcraft and wizardry.
Better yet, and just as ridiculous sounding. Should the Heritage Dictionary or Merriam Webster be allowed to sue her for using words and concepts that they have already defined in print?
Oh wait, those are just research"guides" created for those interested in the subject material… By folks who have compiled lists of words, phrases etc relevant to the core content.

Maybe I'm just a wuss, but I wouldn't WANT to publish my book if the author whose works I was writing about was pissed off about it. Even if I was on the level of stupid where I didn't see that book as plagiarism, I'd still get all "OH GOD, SORRY MA'AM, DIDN'T MEAN TO OFFEND YOU!!" I mean, would it really kill to have some level of respect for the writer's wishes...? You don't have to worship her feet for everything she does, but it's still her freakin' series. Whether you like it or not, crazed fanaticism is not enough for you to replace her as the authority on all things HP.

Alright, I'm done. KICK THEIR ASSES, LEGAL SYSTEM!

I saw the article by Tim Wu a few days ago on an author's LJ, and wondered when it would get up here. (Actually, I was considering posting a link to it, along with the discussion about it on the author's LJ, but then I remembered how [info]cleolinda always does the posts related to RDR, and I didn't want to steal her thunder.)

The author, who's name is Lynn Flewelling, was in support of Wu's opinion at first, and she got a decent response explaining the situation in terms of comments. I can see how anyone would support RDR according to Wu's article... if it's the only thing they had read about the matter. And I think this was the case with Flewelling at first. Amusingly enough, someone linked the fandomwank wiki article on the issue to her, so I think in some ways it has come full circle.

The post in question is here, though it isn't very wanky, and Flewelling is an intelligent article in her blogging habits as she is in writing. I just thought I'd share the page for sharing sake. (Also on there are people who have issues with the way Dumbledore was Outed, among other things.)

Such guides have been around forever—centuries if you count the Bible…

Who’s to say what God’s take on such guides is? Has anyone got proof they asked? I can just see St Peter marking up another lost soul misrepresenting God’s sock puppets prophets and having them pay with their soul. Luckily, JKR will only grind him into dust.

As long as a guide does not copy the original work verbatim, it falls outside the category of "adaptation."

So... as long as we don't literally reprint JKR's books and try to sell them, it's cool?
