The Leaky Cauldron publicly separates from the Lexicon.

[W]e do not think a win for J.K. Rowling means tighter controls on fan creativity at all, and are concerned for the opposite, as well as the attempt to misportray the issues of the case as stated in sworn affadavits. So, after a few days of careful and many-sided discussion, we, as a full staff, decided that people who have such a fundamental disconnect in beliefs cannot and should not be partners in name or spirit, and two days ago informed the Lexicon that we are severing our association....

And while Leaky has always owned the hp-lexicon.org domain and paid for the site’s hosting, we’ve promised to transfer the domain to Steve as soon as litigation is complete (a stipulation that would not have been made had ownership not been mentioned in court documents). We will continue to pay for hosting and provide free support until that day.
Note: Compare this statement to the hosting discussion back in December. There's a pretty big discrepancy there, is all I'm saying.

ETA: [info]lidane brings us a small sampling of comment wank. Also, did you know that this is a Fifth Amendment issue?

ETA 2, via [info]cbm and [info]insanitys_place: The defense has requested JKR as a witness.

ETA 3: SVA leaves a comment at the Lexicon site; the Times Online (UK) weighs in with "J. K. Rowling determined to block RDR Books' Harry Potter 'rip-off' "; a discussion of UK law from another site that has admitted to not reading the manuscript; someone is "baffled at how people are so willing to accept the notion that authors own the ideas they publish"; and I really don't even know what's going on here.

How is it possible that he STILL doesn't know the difference between his free-to-use website and selling a book version of it for his own personal gain?!

Maybe it's the part of him that things one, vague e-mail to JKR's agent = contacting all of JKR's people he could to get permission?

Or the part of him that thinks letting RDR ask about copyright issues and not getting it in writing = him talking to multiple copyright experts before he even met RDR?

Or even the part that thinks insulting one of JKR's editors in a public place = good working relationship with JKR's people.

As all y'all say, it's certainly not Earth Logic.

This is all I'm getting from that:

Plus, the only possible reason why JKR used the website at all? I can't imagine how much notes she had written up on just one book. Why get a papercut when you can just use the internet? D: Besides for porn, obviously.

Because, as has been demonstrated several times, JKR isn't that great at math. The Lexicon was nice for keeping track of niggling little details that would be easy to miss.
Until it stopped updating after Book 6, anyway....

What is so hard to understand? Free information about another person's work = okay. Making money off said person's work = bad. What kind of logic is he following? "Because my free and open-for-all lexicon was approved of by the author and the WB, I'm automatically entitled to gain from the merchandise!"

I had every reason to believe that they would have no problem with a book which uses content that they’d clearly approved of.

Except for when I asked Bloomsbury/JKR if I could make the Lexicon into a book and they said no and I went ahead and did it anyway because when an author/publisher says 'no' they really mean 'yes'.

This really seals it for me. He knew she wasn't going to let this slide, he knew he didn't have permission and he knew it was going to go to court, but he was so desperate to get out of his life, move to England and be famous that he banked on this anyway. Now he's grasping at any straws that might mean he could profit because otherwise he's well and truly screwed. This really explains some of RDR's twisted logic, too, if we assume that SVA skewed the truth to favor himself when he talked to RDR about publication as much as he does every time he talks to fans. If he actually talked to any IP professionals, he probably did the same thing, too. Yuck. He just gets slimier and slimier, every time he opens his mouth.

So I was at Eastercon in London just this past weekend and I decided to go to a panel about children's fiction 'cos Neil Gaiman was on it and Neil Gaiman = cool.

I get in a little late and miss the intros and sitting next to Neil is this kinda smarmy looking guy and when he opens his mouth to make a comment I figure out that (a) he's American and (b) he comes across as a touch self-important.

So I peer at the little card in front of him with his name on it and it read: "Steve Vander Ark".

I swear to you, at one point he actually opened his fucking trap to make a big deal about how I Work In A School Library And I Know These Things (something about the kinds of books girls read.)

It annoyed me so much, I had to leave. Sorry Neil, your sheer awesomeness could not overcome the utter irritating douchebaggery that is SVA.

(Well, plus I was a little cranky and needed a nap. That might have had something to do with it, too.)
