Who's Missing the Torchwood Wank?

I particularly liked the "I have too many quotes, permissioning them all would be too burdensome" argument. You know what is burdensome? Explaining to stupid authors how copyright permissioning works.

You know what's even more burdensome? Having to drop a selection from an anthology, although it is perfect and wunnerful, because the publisher/copyright holder is a douche and wants $30,000 to give permission. Which happens all the time, in real publishing.

Remarkably, the author did a Season One unofficial guide too, using the same technique to gather material. Apparently these things sell really well, because nobody noticed the first one.

Every other fan I've ever quoted in one of my books who's subsequently commented on it or contacted me about it has been delighted to have their work selected and found worthy of inclusion, and to be honest it never occurred to me that anyone might be displeased.

As a member of the OG forum I've checked out the thread about this and the guy is playing the 'but I worked so hard to find and read these reviews so it's totally ok for me to make money off of them' card.

Hm. Given how short the selections are, there's actually a pretty good chance that this would stand up in court as Fair Use, possibly depending on how much material he wrote himself to knit together the stuff he quoted (although a judge may still not care about that and say it's all right because of the attributions). OTOH, even if it's a legit Fair Use thing it's still good form to ask people for permission. If he were quoting from professionally-published online reviews, that would be different; folks doing that have (usually) been paid and if they're in venues like EW or whatever they might expect that short excerpts from what they've written will be quoted elsewhere, with proper attribution, of course. Most people posting things on their LJs don't expect to be quoted in books. Which isn't to say they shouldn't expect that if they post things that are unlocked; they just don't, usually.

That's why it would have been good for him to talk to those people first, so they wouldn't be blindsided by this. I've never heard of anyone successfully suing for being quoted in small amounts, though, without their permission, as long as the author isn't claiming to have written the passage and is properly crediting the person who did. That's how a lot of stuff is written, in and out of academia. It's all about the art of the footnote and bibliography; it's why we have a term like Fair Use in the first place, to allow this sort of thing. Chances are, everything he did is perfectly legal. It still would have been polite for him to ask first, but that's a nettiquette thing, not a legal issue.

He had time to read all those fan reviews to chose the ones that he thought were good enough, but he couldn't spend under a minute on each LJ to leave a comment? He tries to make it sound like the copying&pasting is exhausting and he should be rewarded for it.

The guy really came out as a total jerk with his replies, and the people defending him don't look much better.

I just read the DWF thread: my yearly dose of male privilege. Those silly women of LiveJournal should be grateful their work was reused without permission, dammit! Why must they have such silly, arcane standards of behaviour? Now they're being angry and mean and it's not nice.

Seriously, the inherent gender politics is fascinating. The divide between boy-fandom and girl-fandom in DW has always been stark, but this just opened it wide up.
