So did you hear the news? [info]cleolinda's head exploded Er, I mean RDR Books is appealing.

That's right, you heard me: RDR Books has issued a notice of appeal. Wankas can scarcely believe it. I mean, even Trelawney wouldn't have seen this one coming, yuk yuk yuk.

Naturally, it's reported on various blogs, like Slashdot as well as Leaky Cauldron, and the same arguments from before are rehashed.

You can still refer to RDR Books' website for, uh, information as well.

ETA: Recording Industry vs. The People, which had just recently shared an opinion about the Lexicaon fair use decision, revisits the topic. For those of you who wants to know what {The Common Man} has to say about this.

Also, did you know that the www.hp-lexicon.org was recently named one of the nation's top 15 "Great Web Sites" for children last week by the American Library Association? How embattled.

Info/Law says Slashdot commenters are oversimplifying things, and Techdirt says JKR made her case based on emotion rather than law and says the case is damaging her rep.

Can't say I'm disappointed. The break we had ( what four five months? ) was enough. Ready for new Lexicon-wank now.

And that's just the declaration of the intent to appeal. Then we get RDR's explanation to the appellate judge on why s/he should even bother considering their appeal, and later a response from WB/JKR. Those are what I'm looking forward to, since fandom lawyers will be able to analyze them.

When I saw the notice at Fandom Lounge, my brain misinterpreted it as "RDR Books is appalling." Yes. Yes, they are.

Wonder if this is just a pro forma thing, filing an intent to appeal in order to delay having to fork out the money to Rowling and assigns? As said, they still have to follow through and file the actual appeal, whereupon they'll proceed to get smashed in court again due to the very solid reasons why they lost the first case.

Of course, this is RDR we're talking about, and the barrel of stupid never seems to reach the bottom with them. They could really be going through with this. Oh, well, fire up the popcorn makers, hit the booze stores, and prep the boobie trains.

Techdirt says JKR made her case based on emotion rather than law and says the case is damaging her rep.

1) It's her lawyer's job to make a case based on the law; at the trial JKR was just a witness.

2) The judge didn't make his decision based upon JKR's emotions.

You don't think this will actually go through? I'm envisioning that if they ever do bring it to a judge, that the judge's response to their filing their papers is going to be, "BWAAAAAAA-HAHAHAHAHAHAHAHAHAHAHAHAHAHAHAHAHAHAAH no." And then it gets thrown out of court and nothing else happens.

I can't say I'm surprised. It's sort of like the GOP complaining that Obama cheated by outspending them in the campaign/Sarah Palin bought too many dresses/the economy failing on them which was a total act of god and not in any way related to any Republican policies. Anything is better than just admitting that you lost because you were wrong.

Was it really only a year ago that J. K. Rowling and Warner Bros. sued RDR Books over the Harry Potter Lexicon on Halloween?

It seems more like an eternity, and alot of phrases come to mind. Dark night of the soul. Sold their soul to the company store. In League with the Devil. The Twilight Zone. Through the Looking-Glass. Down the Rabbit Hole. Down the Drain. Boiled in Oil. Keelhauled. Run Amok. Attacked by Harpies. Between Scylla and Charybdis. Nibbled by Geese. Drawn and Quartered. Chastised. Burned at the stake. Run out of Dodge.

But that's really giving the "other side" too much credit. They never actually chased us away, or kept us from writing one word we wanted to write. Of course, people have truly been hurt and reputations have been smeared by lies and innuendoes, and I don't think anyone understands the damage that their constant barrage of negativity has done to people. However, they never really had the big "gotcha" moment in which RDR and Steve Vander Ark were turned penniless out into the street, no matter how many times that was discussed with glee and longing. Many times things didn't turn out the way the Lexicon Haters thought it would - or should I say, every time. And sometimes things became so absurd we had to laugh at the nonsense

Yes, although she won her case, JKR's unprofessional emotionality certainly ruined her reputation as a lawyer. I guess she'll have to make a living as a writer of young adults books or something like that instead.
