With something like art, using a copyrighted piece as a reference is kosher, even without permission.

Debatable. People have been sued over this and lost, if the resulting piece of art looked too close to the copyrighted piece used as reference. Shepard Fairey is being sued for this now, for turning a copyrighted photo into his Obama "Hope" poster.
