It didn't help that Pamela Dean chose not to take action against Cassie, thinking/believing it was a pure accident and nothing to get worked up over.

If Dean had taken action against Fiction Alley (who was the main host of the fic) or Cassie herself in some way I seriously doubt she would have gotten that contract to publish her City of Bones books.
