My memory may be failing me here, but I think US copyright law does make some concessions for derivative works that aren't made for profit, which is probably where the disclaimer culture sprang from (though it'd undoubtedly do fuck all in an actual lawsuit). Certainly making money from derivative works without permission is a good way to attract a lot of attention you don't want from people who actually own the rights.
