I think US copyright law does make some concessions for derivative works that aren't made for profit
It's my understanding that it's more like the 5 MPH above the speed limit that people mistakenly believe they are "allowed"--it's not that you're not breaking the law, it's that it's too much hassle to enforce it. It's harder to prove monetary damages when no money is being made.
