US$305 for mary sue smut?
Step right up, suckers, and place an even higher bid for the Authorized FictionLyn CD-ROM!.

FictionLyn is an Nsync het writer - really long drama pieces, fairly decent writing if you like 'em purple and soppy. What baffles me about this is that it's a CD.

You know, CDs? The shiny little disks that can be duplicated for oh, a buck or two a-piece? And were an author trying to share their work nicely formatted and archived with a fandom, a US$3 CD plus postage would cover costs and time...

But hey, in all our arguments over what constitutes the worst of BFNishness - US$305 is a pretty clear pricetag.

And doesn't this defeat the whole 'fanfiction isn't for profit' idea? She could very easily get sued for that.

In fact, I'd almost like to see that happen, just because of all the wank it'd create. I am a sad, bored little fan.

My first reaction was, "Who in their right mind would pay any amount of money for shit you can get free off the internet?"

Then I thought, "Well, if she's making some extra cash off of people's stupidity, then more power to her."

Which brought me thinking... okay, so she's going to make around $300 off of a shitload of fanfiction. If people are willing to PAY for this stuff, then she must be a damn good writer. WHY is she writing FANFICTION and not writing professionally? You could make SO much more money and get hundreds of times more acclaim writing ORIGINAL ideas and getting them published.

This is just ... insane.

Hot damn, Martha, call the lawyers--there's profit bein' had!

This should be good. If I were them, I'd cover my ass like scalpers do with tickets and offer a copy of an N*sync album, with the fanfic as the "bonus"; it's a loophole, but it seems to work OK. As it is, this is pure profit--no question of time or copying expenses here like you would have with 'zines. The hounds lawyers will descend on this as soon as they're told, I reckon; we could finally have a court battle as to the legality of fanfic :D!

From the statement announcing that she'd be taking the stories down:

I ask that you do NOT put my stories on your own personal sites. If you want to save them to your computer, that is fine. I would also like to remind everyone that my stories ARE copyrighted, therefore it is illegal to reproduce any of them without my permission. (That includes original characters.)

Uh... wouldn't the original characters and the particular arrangements of the words be the only things that she could possibly own? This sounds as if she's claiming the people she writes about, too.

It always amazes/amuses me that so many fanfic writers are concerned with the copyright of their original characters, and whine and squeal about it, when they're dancing on the edge of copyright in the first place.

Technically I don't see much difference between that and this - technically. Still doesn't get her off the hook using a copyrighted name without permission (there's also the probable use of copyrighted images) while the sale is advertised as all profits are going to a person other than the copyright holder AND if any of those stories are into NC-17 territory it's a violation of eBay's anti-adult material TOS.

Oooh I see a BIG can of worms, with the lid off too! *munches popcorn*

Jesus Hillbilly Christ, that is MESSED UP. I would love to smack the shit out of her.

Back in the day, I came up with a couple of soundtrack CDs (well, three) for a long story I was working on and dammit, I will finish someday. People expressed an interest in owning copies of said CD. I charged $4, which included the CD, jewel case, four-page booklet insert and nice label, and postage and mailing in a bubble-wrap-padded envelope. That covered all my costs, and if anyone wanted to make their own, I had all the track lists available and would send the MP3s to anyone who asked. I was so surprised and flattered that people even wanted their own copies, that I'd have burned the CDs and mailed them for free if I could've afforded it.

This shit seriously needs to be reported.

I went to report it only to discover that someone else had already done so, and that the seller had ended the item early in order to sell to the current high bidder.

The whole thing makes me angry. Isn't one of the big points of fanfiction that we're not doing it to make money?

You know, I remember a time in 'N Sync fandom when FictionLyn was a nobody, and then she started picking up popularity (inexplicably). Then her ego got swollen to the size of the damn moon and now this is what happens. Bah.

I followed a link here from yet another rant about this and I have to say, WOW. As a fellow *Nsync Fanfic writer, I'm embarrassed. We are not all like her at all. In fact, I think the rest of us are probably just as appalled as all of you are... if not more. As much as we hate it, she's representing US.

Unfortunately, a stunt like this is not totally unexpected from her. Her ego needs to be constantly fed and this is just another way for her to do that. People have tried to rationalize that she started the bidding at $10 and that's not too outrageous. But, putting aside any legal issues, if she wanted only $10 for it she could have just sold it off her site.

I mean with a reported 10,000 readers out there (her own claim), did she really think it wouldn't get out of hand?

I'm disgusted that she would even ponder accepting money for something so many others do for pure enjoyment. I write for ME, not for money. Like someone else up there said, should anyone want my stories on a CD it'd cost them $3 to cover the price of the CD and shipping. $250?? That's disgusting. And you'll notice that she's taking the money to, guess what? MAKE MORE CDS.

A lesson needs to be learned here. Someone needs to smack her. And the bidder.

Ok i got the link to this whole big long thread from a livejournal on my friends page and i have to respectfully disagree with everyone on this page.

i stumbled on fictionlyn's stories probably a year and a half ago and was really impressed at how sucked in and addicted i got to reading "Sometimes I Wish". have any of you even read the stories? Forget whats going on right now, because none of that was going on until probably a month ago. That's the first anyone even heard of Lyn wanting to sell her stories on a CD.

Slowly, the completed stories came off of the website, much to the dismay of Lyn's readers, and there was a huge demand for somewhere to get them all. Really... if you go read the stories (Saga 2 is my personal favorite) and see what her readers see... you'd see why people would bid on something like this. Yeah, her stories are fanfiction around NSync but the original characters, Miranda, Lauren, Tom, Maitlyn, etc, dominate every story way more than any NSync member does...

I can see how a lot of you would think it was arrogant or conceited to think that someone would pay for this, but what else can you do when there's a HUGE demand for your stuff?

Illegal? Maybe. Why is it making all of you have a hissy fit when it really has nothing to do with you? Its fine to debate the legality of all this, but tattling? Maybe I don't really understand it. The way I see it, she does the same thing you all do... she writes about people who are already alive and defined in character but she had a demand for her completely creative ideas and took the next step.

Anyone feeling a bit cynical about this? How do we know that the winner isn't a sockpuppet?

The scary thing is, I'm inclined to doubt it, because emptypt@gt.rr.com has a history from 2001. S/he likes to buy cards, apparently. Our lucky(?) winner got in at about $42 dollars, and stayed until 265.

And damn, $200+ would be expensive for *published* fiction.

...you have got to be fucking kidding me. and just when i thought i'd finally gotten over my three years of extreme loathing of lyn.

she's not a great writer. she's not bad, but unless she's improved in spades since the last story i read (her third i think), she's not that great.

i have a history with her, in a way. she's the main reason i got out of nsync het after a friend of mine wrote up this thing on her website about how much lyn sucked. lyn's fans sent my friend death threats. it was fucking creepy. and it led to like, this het fandom war. and that's saying something, considering how vast and farflung that fandom is.

oy it was a mess.

anyway, this is fucking ridiculous. what's next? binding the stories together in a book and selling that on e-bay? or did i just give an vastly overfed ego a great new idea?

Just noticed that rachelhatesbees has evoked Godwin's Law.

And I just wish someone would mention that this matter *is* our business. A potential lawsuit on fanfic affects anyone who reads and writes it. RPF's reputation is bad enough without someone gunning to make it a legal issue.
