Ducks, you must Cease and Desist!
Yep. It's true. One of Ducks' websites got a C&D from Fox. Her response: Not only do I *NOT* make ANY money from this, I SPEND hundreds every year, and it's FREE FREAKING PUBLICITY for their greedy, bloodsucking asses. However, she is removing images from the shows though not her fanfic.

For those of you who need a refresher course in All Things Ducks, here are some links:
Meet the Quackers! My first post about the "dedicated" Buffy/Angel 'shippers, including their various ad campaigns to reuinte their favorite couple.
"Spuggy" and Spiketards. Ducks hates the Spike/Buffy relationship and fans so much that she refuses to even type the word "Spuffy." Oh, and she creates a page about how much Spike sucks.
Better Late Than Never? Two months later, Ducks and her ducklings discover the above F_W post and insult me and Fandom_Wank.

Caught up? Good.

The kicker? Some people are crying conspiracy.

Knightfall729: It's the Spuffies. That's who it is! The Friggin' SPUFFIES!
Sweety8587: from over 12 millions sites on the web, not to mention hundreds of thousands of buffy fanfic sites..they had to choose Ducks site?! I sense a conspiracy! (or maybe its just my insanity talking....)

Calmer voices chime in.

Taramisu: What sense does this make at all? Fox starts clamping down on what they feel is copyright infringement, and it's the fault of fans who like S/B? What kind of drugs are you on?
trammie77: That's far enough. Before this goes any further ... There is no proof or reason to point to any fandom and blame them for a letter from Fox. These emails/letters from the network have been sent to other sites long before some pairings ever existed. There is enough disharmony between other ships, no need or basis to create more.

But not everyone agrees.

Cats1: But tell me the truth, does it really surprise you that some of us feel like just *one* Spuffy in all of the hundreds out there might feel like this was a fun way to get their kicks?

No matter what one thinks about C&D letters in general, Ducks and others from the Babble Boards definitely feel persecuted. Of all websites on all the Internet, Fox serves notice to Ducks'.

Okay, the hell? Something about that letter doesn't seem kosher. I mean didn the WB have the rights to BtVS?

And later they went to UPN?

How does FOX fit into this? And why make a big deal about a show that's been off the air for almost a year now?

Something isn't adding up....

Fox does own the rights to Buffy and Angel. The WB and Fox got into a big war over money after BTVS S5, which is why Fox sold it to UPN in the end. I think the letter's legit.

Uh..Buffy isn't even the property of Fox, is it? Wasn't it in WB and UPN?

I can't help wonder if it's some elaborate ruse to put the blame for this on the eval Spuffy people. Even if it's not, it's amusing. Like when Fox was trying to shut down all the X-Files sites years ago.

I got into an on-line 'discussion' with a Duck once that has left me feeling bewildered and antagonistic to this day, and I'm pretty much indifferent to Spike. I can only imagine the reactions of anyone actually involved in making the shows. If there is a more vocal bunch among the more obnoxious whacked-out fringe of BtVS fangroups, I haven't heard of it. Has anyone pointed out to them that that could that explain the cease-and-desist order right there? That and they're using Fox's material to make their anti-Spike propaganda. (I suppose I really ought to go on their site and look, but I'm too afraid of getting sucked in to look past the first page.)

Ten two one what happened is someone that didn't like her site or the contents complained to fox. Unfourntely thats usally the way it happens....what what fox? They never were on Fox..they we're on WB and UPN and hell Joss as his own proudction company.
Something smells rotten in denmark...

WB and UPN distributed BtVS and AtS, but Fox and Mutant Enemy (among others) produced it. I'm guessing Fox owns the rights because they put up most of the funding.

I dunno, nineteen times out of twenty, when one of these C&Ds is sent, I come down on the side of the fan. I mean, hell, look how fast everyone rushed to ZorroRojo's defense when journalfen got a C&D. I really fail to see how her putting up a bunch of screencaps is going to deprive Fox of money, unless they figure it cheats them out of the ten people or so who would have bought the DVDs just to freeze-frame those particular images and stare at them.

And I'm with you on the fan vs. C&D issue; seriously, who are these fansites hurting? Aren't they actually free publicity? (Unless you take one look at the fansite and say, "Wow, these folks are fucked up-- I'm outta here....")

IMO, the wank lies not in the WM vs. FOX issue, but on the "It's the SPUFFIES!" conspiracy theory... thingy. I mean... please.

Mostly, I tend to be on the side of the fan in the old C&D cases, too. But this time...oh, I know its mean, but I decided that particular branch of B/A'ers were worryingly scary a long time ago so this time I can't seem to care.

Also, I'm with Taramisu on this one - it has to be the Spuffies? WTF?

I have to agree. Unless she's making a profit on it, doesn't it fall under fair use, since she's only distributing freeze frames of episodes?

Though, I do admit...you shouldn't really publicize hate sites.

For those who are confused on this point:

20th Century FOX owns the distribution rights to Buffy. Yes, it aired on the WB and then UPN, but both networks bought the rights from FOX, the production company(?), of which the network is just one facet.

And yes, FOX has done this to various Buffy fansites before. The letter in this case may or may not be legit, but if it were legit, it would, in fact, come from FOX.

Question:

Are fans still willing to support companies that shut non-profit, fan-sites down?

For example, I know I'm thinking of yanking my patronage to Victoria's Secrets since that company is kill-happy where fan-sites are concerned, and constantly orders cease-and-desists to very good fan-sites.

Would you guys be willing to do that to... say... Fox if they went that far?

So, Ducks' creates a page dedicated to insisting in a REALLY BIG FONT that Joss Whedon thinks rape is fun and a really funny joke, calls him a sick, twisted whore, brings up his family, uses copywritten images belonging to his financial backers as source material for art that slanders him, and then publicizes that page all over the internet - because if I heard about it everybody heard about it, I'm notoriously out of touch with any part of fandom that isn't TWoP or my own LiveJournal Friends list - where the hell was I? Oh yeah, okay. So, she does all these things and then has the gall to express surprise when Joss puts his boot right up her ass? Cry me a fucking river.

Ducks, dear. Dear, dear Ducks. She begged for Daddy to notice her, and Daddy finally did. Then he called his daddy's attorney, and Ducks got a 'panking, because they're copyright holders and Ducks - like everyone in fandom - is ultimately an irrelevancy. Lesson: fan sites are allowed to exist when they are regarded as either benevolent or benign. Ducks went out of her way to create a site that existed solely to slur the very people whose copyright she was infringing upon, and in doing so became a liability. How notoriously stupid, and how entirely disingenuous of her to pretend she's an innocent injured party who was just doing those ungrateful Nazis a favor by making crazy-pages that called for their heads. She went too far, and she got her nose thumped.
