Fandom Scruples is at it again, now deciding that legal action is needed for websites that don't comply with their views on protecting the children.

We have compiled evidence against several websites who have knowingly violated this law.

We believe everyone is responsible for the social welfare of children online and that website owners can easily provide adult authentication access for free or for a fee to adults.

There are no excuses. We have come to a decision that we will give websites two weeks to comply with COPA or we will report them to a federal agency that we have sought advice from.

Of course, you can't comment in that entry, only boggle at their behaviour.

There was some controversy about ivyblossom being on the list as she locks down her fics on her website. While we applaud her doing this, we've browsed several fics on her LJ containing what we consider to be adult content and she will remain on the list until those things are locked down.

Oh. My. Lord.

Someone please rent these people a copy of The Front, and make them watch it repeatedly until they Get It.

Yeah? Well, you're wrong.

For a FEE? My God. Heck, wouldn't that be illegal under copyright laws, because you're profiting from fanfic? Solid thinking there.

Are they nuts?????

Well, aside from the inherent wankiness of their entire existance, there is one more major flaw in their 'argument'.

The Act makes it a federal crime to use the World Wide Web to distribute "for commercial purposes" material considered "harmful to minors,"

I wasn't aware that site owners/writers/slashers were making profit. What 'commercial practices'?

This has got to be a troll.

Or someone with a real hate-on for the people s/he is targeting.

There's a much easier way to do this, if s/he were serious -- drop a bug in JKR's lawyer's/Bloomsbury Press's ears. They're the ones who asked Restricted Access to do the password protection, IIRC.

Or, of course, transfer website control to a non-American. Then US laws become somewhat pointless.

...and how exactly are fic archives being used for commerical gain?

I need a "bitch, are you for real" icon. Or at least one of those cool "OH MY GOD WHAT THE HELL ARE YOU DOING?" ones.

To those who might not know it, Child Online Protection Act (COPA) was passed on Oct. 21, 1998. The Act makes it a federal crime to use the World Wide Web to distribute "for commercial purposes" material considered "harmful to minors," with penalties of up to $150,000 for each day of violation and up to six months in prison.

Erm... Were they skimming the Act as carelessly as I was skimming their entry? Or am I just not getting something?

Idiots. Do they honestly think anyone is going to give a flying fuck?
Firstly, everyone is not responsible for children online. That's what they have parents for. Let parents actually do their job, because it sure as hell isn't my job.
Secondly, their 'we'll give you two weeks, but then we're telling!' attitude makes me giggle. This probably wasn't the desired response.

You know, if I found myself on their friends list, I'd likely be struck with an overwhelming desire to write some serious HP-smut. Just because.
