Well, it seems DA's slipped in a rule, number 304, that states, essentially, that they won't be laying the smackdown on tracers and plagiarists under the excuse of 'but they're just larnin'!'

realitysquared posts regarding this bit of stupid, and lo, the fap is brung.

OH GOD. This.

This would be funny were I not in a bitter, bitter hatred of DA. That has existed since I started using it. I just can't believe these poor disillusioned folk - didn't you know that DA's TOS tells you that they eat your firstborn and steal your art? (It does. Maybe not the firstborn part, but that could be couched in legal terms.)

This also would be funnier if DA weren't the little turds they are. This same wank has already happened a hundred times (I've personally seen more than 40, I know that, and I've heard far more mentioned by other people), but DA has always cracked down on threatening to ban all involved parties (save for the tracer) before the wank could get out. Then they threaten to ban anyone who mentions the incident. (Has gotten warnings for this, if anyone doesn't believe that bit)

The worst part of this wank? The little people are all left out. Everyone's heard by now of the ten or so people directly involved in this - what no one knows is that it's happened so much that I think DA has a lot of the art_theft members of a blacklist or something. But the girl with all the friends will go down as "fighting the DA power," completely ignoring the people who every day report art thieves who aren't even stealing their own work.

Because it was gross? Man, one of the people I watch has been posting pictures of dismembered and sewn-together bodies for a year now and hasn't been affected - how far do you have to go to be considered "gross"?

I haven't had any problems, although the only place where I'm skirting the issue is in not putting 'mature' labels on pics that contain nekkid male butts - I'll do it if the admins tell me to, but figure drawing is art, dammit, and if people can't handle naked buttocks in non-sexual situations, then they shouldn't be looking at art.

Mind you, I did put a 'mature' tag on the one that contained full-frontal male nudity, but that's because I'm a wuss, too, and figured that would would get reported tout suite. :)

Nitpick: plagiarists are text-based. If you're referring to graphical works of art, you want "copyright infringers," and rule 304 refers to images only, so it doesn't affect plagiarizers.

The problem is that US law is currently up in the air about copyrighting characters. Because I am lazy and don't want to summarize, I'll just point to http://www.publaw.com/graphical.html. So, legally, it's hard to say where you go from a "type" to a "character" and DA has chosen not to be the police on that issue, which is probably the same choice I'd make, were I in their place.

Anyway, they do say that tracings aren't allowed, the the work needs to have been made entirely by the ~~copier~~ artist in question. This is much looser than US copyright law is, which requires substantial creativity on the part of the copier for the new work to be considered original, rather than derivative work.

Crap like this is why I intend to REGISTER my original characters with the copyright office and not put much more than a few partial-sketches of them online until I have that piece of paper in my hand that says "Yeah, legally, you made these."

Putting anything original or semi-original online is like going to work and leaving your house unlocked; free for all. Sure, I WANT to believe that 99.9% of the people visiting my house would just walk through, laugh at my horrible tacky furniture and clumsy layouts- but that .01% that start filching the spoons is potentially enough to put me, the startup amateur wanna-bee artist, completely out of business.

Once the bastards are properly registered though, I'm gonna pimp them like whoa.

	Watch out - deviant art still won't respect them, even if they are properly registered. They allow character & pose theft, as well as eye-balled copies and traces. Yup, I saw that as well...hell, one of the people involved is on my watchlist. I feel sorry for you artist-folk and am glad as hell that I only use that shithole to post my old poetry.

[giggles a bit] It's funny; the kiddies who flew to Sheezyart were right. DA is batshite and it's just getting worse because either artists become proactive and are smacked for it, or they don't stop whining and doing nothing. The pressure is building; who will survive the Wanksplosion?

I won't. >=D I'm still prodding around DA, trying to find the little button to cause said Wanksplosion. Usually, they tell people to remove all referrences to any other people or any incident on DA anywhere - for instance, usually DA wouldn't have allowed those people to talk on their journals. I think what happened this time was that everything that happened was too quick, and there was already wank before the mods could threaten to ban everyone's sorry butts.

If you know a quick way to rally lots of DA folks and piss of the admins simultaneously (in a way that might make them change their copyright-hating ways), lemme know. Still looking for it.
