Death Threats and Internet Lawyers on the COS Forums
Came across this at The HMS STFU. A poster on the Mugglenet-affiliated COS forums claims to have received a death threat and is threatening to sue the other poster, Mugglenet, and "and the atmosphere that condones it."

Legally, that statement as presented on a public board, that is, a board that is not by invitation only, can be construed as a threat, and I am in the process of looking into legal action against it, and the atmosphere that condones it, which is certainly evident in this thread as well. That kind of attitude is what you have all been condoning.

Whether you like a character or not is an opinion. Whether you feel one character has better motivation than another is an opinion. Whether one character is better developed than another is opinion. You can't misinterpret fiction canon, because fiction is seen by the reader each in their own way. This is not a biography, or a documentary, where facts are simply presented as facts. It is a work of fiction, which anyone can interpret any way they want. And that's the last word I have on the subject, pending further developments.


The 'death-threat' has been deleted by the COS forum mods, if anyone's wondering and the poster banned. But that's not enough now, is it?

ETA. MRSTJ1 (whose user profile incidentally has her as fifty years old with four children) is discussing further details of her lawsuit against Emerson Spartz and Mugglenet. Details here. And it is pointed out that Emerson doesn't even own or mod the forums in question, so this woman is even further out to lunch than I thought.

ETA 2. The litigious one says hello.

If the post wasn't out of line, then why did the poster get banned and the post deleted?

Taking legal action against "the atmosphere that condones it"? That's a new one. Just imagine if you could take legal action against generic idiocy, and have it locked up. It might have some benefits, but I also suspect F_W would suddenly get a whole lot less entertaining..

After re-reading the post three times, I'm still not seeing the death threat here, and so not getting why the poster is getting her (his?) panties in a twist. I mean, death threat is "Imma keel joo, bitch," or something of the sort, not "you should just die." If the latter is a death threat, that's one of the most passive death threats I've ever seen. You get worse on high school campuses.

The lawsuit is painfully stupid and that's not a death threat, but I always get a little disturbed when I read any sort of "You should just die/kill yourself!" comment in reaction to reading an unpopular, disliked or wanky opinion. It's creepy and an indication that any kind of healthy perspective has zoomed right out the window.

Or perhaps I am just an overly sensitive, delicate flower. *wilts*

The "you should all die" comment was pretty stupid, but why on earth is this person taking it seriously? It was not a nice thing to say, and the poster was banned for it. Problem solved, no?

Personally, I wouldn't take anything less than "I know your full name and/or address/IP and I'm coming to kill/beat you for [insert relevent wrongdoing]" without a grain of salt. People say and do a lot of things on the internet that they wouldn't dream of doing in real life. And many people (especially teenagers) use "die" interchangably with "go away". *shrugs*

I don't care how fictional HP is, there are limits on the freedoms of "interpretation," and statements like the above are the stuff wank is made of. We are not debating what could be, what would be, or what should be, we are talking about what a lone, live, autonomous author wrote in her very straightforward series of fiction, and just because you can't read, doesn't mean she can't write. Some things happened in the books. Some things didn't. Screaming about "personal interpretation" after people have demonstrated to you that your complaints, theories and character-bashing aren't supported by canon, isn't going to change the fact that on many, many fronts, JKR's intentions have been made very clear by now.

Ginny was not "a bitch to her mother," she was not "a bitch to Hermione," she did not "date half the school," she did not "jump Harry in the common room," and if getting your kiester handed very politely back to you on a platter held up by the published works of J.K. Rowling is so very painful to you, find something else to do on the Internet than ranting about how much you HATE HATE HATE one of JKR's favorite fictional creations and then running back to your buddies to cry about how the big scary OBHWFers are so meeeeeeeen to anyone who (can't get their head out of their ass) "disagrees with them." Whining and stamping your feet while trying to force your easily refuted statements down disagreeing fans' throats isn't going to make Harry fall for Luna. You can say you believe the moon is made of green cheese because that's just how you "interpret" what you see in the sky. It's made of rock no matter what you say.

Scott Adams said that of you describe your job as "I am in the process of looking into setting up a meeting to discuss a potential consulting assignment.", then you do not actually have a job. Similarly, I think MRSTJ1 does not actually have a leg to stand on.

I'm not even sure that's legally a threat; it doesn't announce intent, nor desire, to cause harm to others. Even announcing desire to harm another isn't a threat, right? If it is, I may have to apoligize to my parents.

I'm torn between giggling at the stupid and sobbing at the fact that there's always a self-righteous, legalese-spewin', Bill of Rights-totin'... stupid person hiding in the woodwork, no matter where you go on the intrawebs. C'mon, it's two zero zero freakin six. This shit was already stupid ten years ago. >:0!

It's the least satisfying book as a stand alone novel, which is what we all paid for. We didn't pay for any of the other books to be a preamble of the future, even though we knew there were going to be future books. They all had big payoffs, and ended at logical points. Why shouldn't we expect that with this one, and why do we have to like it that we didn't get that? God bless all of you that can, because I can't.

It's just a flimsy excuse for palming off a lot of crud, with no payoff. [...snip...] It said LESS in more words, than other of the other books ever did.

Kind of like threatenting legal action instead of just saying "Waaahhhhhh!!!"

Again, NO PAYOFF for the time and money we put into this. Just an offhand statement telling us to wait until next time.
