Epic burn

[info]cleolinda
Previously on The Hundred Years' Wank: RDR demands to see JKR's notes, judge lols; RDR files its response; the NYT weighs in; grudgepuppet accuses TLC's Melissa of tax fraud, recipes ensue.

Leaky grudgewank hits the Times Union. Key sentence: "Fansites such as The Leaky Cauldron and Mugglenet have been selling ad space on their sites for years and some have cried fowl."* Includes wank in the comments.

* Which fowl? "TURKEY! PHEASANT! CHICKENNNN!"

And then: JKR/WB Respond in Lexicon Suit. From TLC: "This is the last filing before a hearing on March 13 to determine if a preliminary injunction will be granted. After that there still may or may not be a trial to determine if infringement has taken place." Key points )

Whew. *goes to have a lie-down*

ETA: From [info]karintheswede, "Methuen, the British firm set to publish the Lexicon if RDR/SVA win, is ' "fairly confident" the court will rule in RDR's favour,' according to The Bookseller."

ETA 2 from TLC: "Harvard Law Wayne State University faculty and copyright/IP professor Derek Bambauer says that a recent NYT article on the case "Foul[ed] Up Fair Use" and contains an "embarassingly simple mistake of copyright law."

ETA 3: The filings are finally up at Justia.

ETA 4: Most viewed new story on Yahoo News: Rowling bashes 'Harry Potter Lexicon.'

ETA 5: RDR Books speaks. Read more... )

ETA 5b: The Lexicon story hits Smart Bitches, Trashy Books.

ETA 5c: From [info]ravenbell: an article from Cinematical: "Discuss: When Fans Go Too Far." Includes wank in the comments; I'm not really sure what's going on with the "bright shiny snowflake" comment.

ETA 6: Nora Roberts speaks:
Fan fiction doesn’t copy the author’s story and call it their own, but uses it or the characters, as a springboard for another story. And not for profit. Much different, to my mind, than what Edwards did over many years and with many sources.

But this suit seems to involve someone who IS taking the author’s words, without her permission, and trying to sell it for profit. I’d sue, too.

I don’t mind fan fiction (understand those authors who do), but when I find my work on the internet--for profit or not--copied and claimed by someone else, I shut it down.

NORA ROBERTS HAS SPOKEN.

"OMG! You pointed out her plagiarism, you horrible meanie!"

[info]pyratejenni
Over on LJ, [info]psycholullaby posts about some plagiarized FMA fan art. [info]dramaqueen9731 posted a "You hurt her feelings! Shame on you!" comment then deleted it, but [info]psycholullaby posted it in an ETA for posterity. Not to be outdone, some other naive schmuck poor soul tries to makes a similar point. Needless to say, no one on the thread busy it

At some point, according to her ETAs, the plagiarized art was taken down, and the offender, esteltinuviel, posts a Heidipology comparing herself to Gandhi and MLK Jr.

[info]psycholullaby isn't pleased, and posts the screencaps of the plagiarized artwork.

It's kinda nice to see FMA wank. It's been a while.

ETA: For your viewing pleasure, comparisons of the artwork in question. Tip o' the hat to [info]onaga for grabbing the link, because I was lazy.

Savage Wank, Stolen Thunder--Cassie Edwards part 2

[info]pepperlandgirl4
ETA 2: Cassie Edwards has THE BIGGEST BALLS ON THE PLANET. They hang all the way down to her knees.

SAVAGE OBSESSION
Page 549
“I, alone, the chief’s wife, did as you asked. Do you now truly believe the cornfields will be more fruitful?”
[…]
“You have blessed the cornfields. The passing of your footsteps drew a magic circle around the field of freshly planted maize. No insects or worms shall pass over that magic circle.”

HIAWATHA
Section XIII, fourth & sixth stanzas
To his wife, the Laughing Water:
‘You shall bless to-night the cornfields
[…]
Thus the fields shall be more fruitful,
And the passing of your footsteps
Draw a magic circle round them,
So that neither blight nor mildew,
Neither burrowing worm or insect,
Shall pass o’er the magic circle;

&&&&&&&&&&&&&

SAVAGE OBSESSION
Page 549-550
When night had fallen in their village and all was silent with the spirit of sleep a companion in all the St. Croix’ wigwams, Lorinda had crept from her tent, alone. Once outside, beneath the soft reflection of the April moon, she had laid her garments aside, knowing that Yellow Feather had assured her that no eye would see her.
[…]
she had begun her slow circle of the field, around its borders […]

HIAWATHA
Section XIII, fifth stanza
In the night, when all is silence,
In the night, when all is darkness,
When the Spirit of Sleep, Nepahwin,
Shuts the doors of all the wigwams,
So that not an ear can hear you,
So that not an eye can see you,
Rise up from your bed in silence,
Lay aside your garments wholly,
Walk around the fields you planted,
Round the borders of the cornfields,

There's more at the link. THIS SHIT IS B-A-N-A-N-A-S!

ETA: Cassie Edwards has BIG BRASS BALLS.

From my inbox:

SAVAGE OBSESSION
Page 284 (pg 434 in Large Type edition)
The odors of the forest, the dew and damp meadow, and the curling smoke from the wigwams were left behind as Lorinda […]

HIAWATHA by Henry Wadsworth Longfellow:
Lines 3-5 of the Introduction
With the odors of the forest,
With the dew and damp of meadows,
With the curling smoke of wigwams

From Nikki the Super Badass Researcher

I REPEAT: BIG BRASS HANGING BALLS.

Seriously.

A lot of stuff has happened since the first report. So much so that I didn't think a bunch of "ETAs" on the original would suffice.

From the comments, Our own [info]doyle Found more examples of plagiarism. She lifted directly from the encyclopedia!

Signet takes this seriously. Cassie Edwards says she had a horrible thing done to her. )

First We Stole Their Land---Now Cassie Edwards Steals Their Prose

[info]pepperlandgirl4
Or Raccoon Penis Quill Wank.
ETA: Part 4
Cassie Edwards lifted passages from 1930 Pulitzer Prize Winner Laughing Boy.

ETA: THE RETURN: Signet responds. Don't worry. It's not "really" plagiarism because it's not copyright infringement. Cassie Edwards responds in an AP Article. It can't be plagiarism. She didn't know it was wrong. Fortunately, as per her publisher, it wasn't wrong.

I wasn't sure if I should put this here or OTF_Wank, but I figure since the Anne Rice wank shows up here, I'd go with F_W. If it's wrong, my deepest apologies.

Earlier today, Smart Bitch Candy makes a rather serious accusation about popular romance novelist Cassie Edwards. If you don't know the name, she's the author of over 100 books, including such classics as Savage Winds. Candy gave her friend a book called Shadow Bear, and her friend immediately did what professors across the country do every day--notice a huge discrepancy in writing styles and suspect something strange is afoot at the Circle K.

Cassie Edwards is a plagiarist.

So they started to Google. )

ETA: But wait! There's more!

ETA 2: As seen at SBTB. The guy she ripped off? One Charles Alexander Eastman. If you don't recognize the name, you can find out more here. Including the interesting fact that he helped to found the Boy Scouts of America in 1910.

"Well, unless you find lawyers sinister"

[info]cleolinda
I really apologize for this--it really is starting to get ridiculous, the number of entries. If people are really, truly sick of Lexicon wank or want to boot it into the Cornfield, let me know.

In case you missed, uh, ETAs 6-8:

RDR spokesman writes to the Terminus 2008 staff.

A PDF file of the actual filed complaint.

elanor_isolda counters several of the allegations. ([info]sententia brings up an interesting point re: Elanor's entry: "Taking the Lexicon completely out of the equation, Warners/Rowling thought that the material was obviously fine when it was published (word for word) by someone else [the plagiarism alleged by Elanor regarding another book on Amazon] otherwise they would have sued them/served them with a C&C order, so why should they sue when Steve uses those exact same words? I find that bit a little weird.")

New: SVA updates the the Lexicon's What's New page. "NOTE: I know that many people (waves to the JournalFen crowd) are seeing conspiracy here with the comments gone, but to be frank, it’s nothing sinister. Well, unless you find lawyers sinister." I'm not going to make the obvious joke on that one.

WatchThatPage tells me that something's different about the RDR Books Lexicon page, and it cites this section: Read more... )

Can anyone tell if any of it is really different, in the interest of equal time?

Note: So many fan reactions are following the Snacky Template that I don't intend to link to anymore unless there's something really spectacular. That said, you can always discuss anything you find in the comments.

ETA: Since it's just not HP wank without accusations of plagiarism, the Hannah Abbott entries she mentioned are very interesting compared side-by-side. Images )

ETA 2: From [info]white_serpent: Why the Great Timeline Duplicated Date Error may not be all that airtight a piece of evidence.

ETA 3: Remember what I said about no more fan reaction links? Well... from [info]narcissam: "We are declaring today Steve Vander Ark Day, November 1 - All Saints Day."

Also, a nonnymouse just left me a comment: http://www.stevevanderarkfans.com. Interestingly, it predates this whole saga by a good three months at least.

ETA 4: Another mouse: "The judge in the case says RDR Books has to come before the court on November 19. Also includes some of the info from the Lexicon that they plan to use in court." Barring a settlement (which is where I'm laying my money. Uh. So to speak), that's a while for y'all to wait.

ETA 5: The RDR Books page has changed again: By now the story of the J.K. Rowling/ Warner Bros. Halloween lawsuit aimed at Steve Vander Ark's Harry Potter Lexicon has become news from Shanghai to South Bend )

ETA 6: Accept no substitutes! Plus, a new filk. That said, I am determined to stay on this one entry unless/until something earth-shattering happens or we hit ETA 20.

ETA 7: From [info]narcissam: Hey, I wanna win )

ETA 8: From elanor: WB has now seen the book? Is it possible after all "to settle this case to Ms. Rowling's satisfaction and publish the book" [my emphasis]?

ETA 9: From TLC: Update on JKR/WB vs. RDR Books Case: "The day before last, a court ordered RDR to hand a copy of the manuscript to J.K. Rowling's lawyers, and one was delivered, according to those lawyers. JKR/WB are seeking a preliminary injunction (source here) to the sale of the book, and have not apparently been deterred by viewing the manuscript. RDR has also made claims on their web site that they have "repeatedly offer[ed] to settle this case to Ms. Rowling's satisfaction and publish the book," requests which apparently have not been agreed upon. TLC has asked RDR what the settlement was and has not been met with a response."

ETA 10: Praetorianguard has posted another analysis. I recommend reading the comments as well. Also, an interesting point regarding the book alleged to have plagiarized the Lexicon (see Hannah Abbott screencap above): Read more... )

ETA 11: Another anonycomment: Apparently when RDR (allegedly?) said "Print out the website," WB took them at their word.

You're the lying, cyber-stalking sock-puppet! No, YOU ARE!

[info]karaz
Mysticdreamer32 calls shenanigans on Stylophile. She claims that Stylophile also writes under the penname C.Roxane, and says she saw the name on an archived fic that is also credited to Stylophile elsewhere.

Stylophile pleads her case to a sympathetic flist. She denies ever using that pen name and thinks this 'C.Roxane' must have plagiarized her HP H/D fic, Tempus Fugit. Alas, Mysticdreamer32 is not satisfied because she says that C.Roxane has been harassing her. She is adamant that Stylophile is this same liar*, cyber-stalkery sock-puppet.

Mysticdreamer32 shows up to battle in comments. Flist asks Mysticdreamer32 to prove it or STFU and Mysticdreamer32 basically says the emails for both pen names are the same. However, she shows no proof of this.

Enter an abashed Glomptackle, who explains that she's the archive mod and it was an honest mistake that listed C.Roxane as the author of Stylophile's fic. She has no reason to believe that they are the same person, as C.Roxane doesn't even write HP fic, and suggests that Mysticdreamer32 stop bothering Stylophile.

That's not good enough for Mysticdreamer32. She continues to assert her accusations anonymously after Stylophile brings down the ban hammer. It's also worth noting that Mysticdreamer32's LJ is a bit on the sparse side, mostly just recs, including - wait for it - a ton of C.Roxane recs! And hang on, what is Mysticdreamer32's first name? Christy! You don't say... (see eta 2)

Now Stylophile is convinced that Mysticdreamer32 is actually the cyber-stalker and asks her to bugger off again.

* )

ETA: BUT WHAT DOES IT ALL MEAN!? What? You thought I knew? I was hoping one of you brilliant detectives would wade through it all and figure it out.
ETA 2[info]white_serpent has uncovered that C.Roxane has some issues with Christy. So it looks like we can be pretty sure Christy isn't C.Roxane. (Unless she's gone MsScribe on us at which point, I quit. I'm not sorting that out.) Just who was stalking who anyway!?
ETA 3: [info]white_serpent is my hero. Here is the most likely explanation.

[info]derryderrydown
[info]pureimmortal decides to make a database of all the Harry Potter fanfiction she has on her computer and then share it with the world. Unfortunately, she's using Access she doesn't contact the authors to get their permission.

When she posts a list of all the stories she has available, without details of author, pairing, rating or warnings, and offers to email them to anybody who wants them, the authors get a little upset.

Only a *little* upset. )

ETA: And we have a response!

ETA2: And another response!

Moar House Wank!

[info]showbiz
I just woke up, so apologies if I goof up anything.

Plucky girl detective [info]cryptictac has discovered that [info]awwsugah has been repeatedly and blatantly thieving from several notable authors in House fandom and reposting fics on her Myspace as her own, including claiming [info]pirate_eggie's Howse comics as her own. One of the summaries attached to a fic that she (re)posted:

I was bitten by a plot bunny this morning, and between that and finding out that I actually have an AUDIENCE for my fanficition...here is your drabble of the week. I will probably expand this into at least a ficlet, as I personally think the idea is genius. Title: Everybody Lies

Oh, sweet, sweet irony! The Myspace blog has since been set to private, but there are caps linked to in the post, and there is a tenuous apology from [info]awwsugah.

ETA 1: A more complete apology here, but this:

As for my motive... there was none. It was directly after Hurricane Katrina that the posting began and I truly had NOTHING TO GAIN FROM IT.

Hurricane Katrina made me do it!

ETA 2: Minor lol-inducing comment - [info]savemoony: "I don't mean to sound hyperbolic, except for the fact that I totally do but plagiarists are up there with murders to me. I have *no* tolerance for them." That's almost on a par with the famed [info]julia_bohemian's trolling/wanking = child molestation, don't you think?

Plagiarism doesn't count if I think you have talent!

[info]princessdot
shezan dislikes snitches, especially those snitches writing the Cassie Clare outing on [info]bad_penny. She leaves vitriol to any who diss Cassie's good name. It's not plagiarism, it's practicing. Also, anyone who believes [info]bad_penny is twelve.

This police state is alive and kicking. And knows that your IP has been caught red-handed. Posting anon at the [info]bad_penny. For you see she's also a mouse, but she doesn't like it when the mod points out she's lying about it.

~toodles off to assign [info]charlottelennox the new title of Better Than Bob Woodward~

ETA:

ETA II: She might finally like Charlotte's writing, but [info]white_serpent strikes her as too much of a police informant. Ahh, like a snitch?

ETA with whine and cheese: wanna see screenies? then ask for them!=p

me, myself and I

dodyskin
It's an old story: HP fangirl creates sock, plagiarises (self?), denounces sock, confesses to all, and thoroughly underwhelms audience.

(from a mouse to your screens, dramione drama)

Stone the infamous slytherinjoli, er... cs_kurumi.

It was me all along! Woe. Regret.

The chorus: "I don't care!" "I care even less" "I'm not even conscious!" and further illustrated apathy.

Sorta like icon wank but not.

[info]ennui
Small, but the panty bunching is kinda cute.

Fanartist [info]vikingcarrot makes a post about a little fangirl stealing her userinfo (to me it looked like she only appropriated a not very original template, which is bit naughty, but not teh evol!111!!) and her friends make comments about creepy, stalker fangirls stealing identities. Fangirl apologizes, changes her info and defriends fanartist, but this is too wanky for [info]vikingcarrot, "ETA: She's changed it, yay. Also defriended me, which does not surprise me in the least. God that was wanky." But, OH NOES, then the fangirl deletes her journal in order to steal a new identity. Or not.

(Fangirl under 18. Original report removed because it showed a screencap of her userinfo, which isn't allowed. But since the wank wasn't hers or in her personal journal it seems I can still post the wank. Y'all'll beat me if I've got that wrong, right?)

ETA: comments tell me that the wank has been bah-leeted, or locked, or swallowed. At least one comment also links to
"And that's all I have to say about it and I will post no more on the subject."

Bi-sexual and Bi-lingual Pegasus Wank-tasy here!

[info]ladyofviolets
Ah, old school anime wank is precious. Specially if it's Saint Seiya wank. I haven' seen StS wank THIS good since a certain online shop specialized in StS stuff got bitched at for supposedly staling merchandising, many years ago...

Get your Babelfish ready and COME WITH MEEEEEEE!

Enter [info]holymegasaint, member of the [info]saintseiya community in LJ. She posts spoilers without lj-cuts, posts only in Spanish without translating, and is heterosexist in the "ZOMG I LOVE HET AND YAOI/YURI ARE WRONG! way.

So... Non-wanky? Wait!

She "writes" an essay in Spanish about a certain Virgo Shaka, Gold Saint and Fan Bait Extraordinary. One of the StS comm members, however, soon notices that it's just the translation of another essay, which is originally in English..

People call her thief. She delets the comments. The author of the original essay waltzes in...

I stole from you because I wanted people to SEE MEEEE! ZOMG WANGST! )

for the ones that signaled me as a thief. YOU ALL SUCK YOU YAOI SLUTS! )

She says it's the last time. But it is NOT. There's a sort-of Spanish test about Saint instincts... which is a silly tweaking from a Spanish test about dogs.

And Spanish fans are now calling on her.

Of course, she banswhoever dares to criticize her, then insults him/her/it. (Spanish link, I'm just too tired to translate.

For the love of Athena, Odin, Poseidon, Lucifer, Eris, Ares and/or Hades, PLEASE someone stop this bitch. She's 25 and has the mentality of a rude, bitchy, and spiteful little girl.

Edit n°1:
Bookworm-e reminded me of these little jewels. Thank you!

First: A Poem about Myself. Only that I wasn't the one who wrote it - I actually used Enigma lyrics and thought no one would notice. And I also throw some more shit at yaoi when 'provoked'.

Second: What a pretty song by Eddie Reader. Of course i'll translate it and try to make it pass as mine! Silly me!

ZOMG the st00pid burns.

----

Edit n° 2:

[info]darknightrain translates her own Words of Wisdom!

Bitch you got pwned by me! TWICE! )

Edit n° 3:

BAH-LEETED COMMENTS HERE! In both Spanish *and* English. Image-heavy. Thanks to [info]bookworm_e and [info]inupr0n for everything!

FIRST BATCH. Essay on Shaka comments

and

SECOND BATCH. How to Train you Saint

----

Edit n° 4: MORE FORMERLY DELETED COMMENTS COME BAAAAAACK FROM THE DEEEEED! N°1 and 2 in Spanish and n°3 in English.

ALL the posterior bitching in the Train your Saint post. Complete with Mary Sue jokes and jokes about fangirlism.

ALL the posterior bitching in the Shaka essaypost

This happened when she posted the translation of the Train your Saint shit at the Saint Seiya comm.

Since Slayers is a fandom...

[info]tarahime
I bring to you all my first wank report, courtesy of the lovely wankers at DeviantART.

It all starts out at the fanart gallery of a person called animecartist, a Copy Artist, whose choice of art style is to basically recopy original official art from several different anime series. However, it is not limited to just that as she has also taken the liberty to copy someone else's fanart.

I can smell the wank already )

You're just jealous! She's a better artist than you'll ever be!! )

More Deleterius Wank!

[info]goldberry
So, [info]indehiscent posts to [info]deleterius asking if anyone has stories to lend her for her creative writing class. The members proceed to eat her alive. 'Nuff said.

Edit - Bahleeted! Did anyone catch a screencap?

Edit the second - [info]psychofangirl managed to save most of the original wank - it can be found here and here.

Also, "It was a joke!" cries [info]indehiscent.

[info]drhikari
First time poster, recent lurker. Herro there. Forgive my english, I am not a native English speaker, unfortunately.

My fandom, Rockman.EXE, is part of a bigger fandom (Rockman) which is overall peaceful, but we get wank from time to time. Um, make that "all the time". There's this board called Rockman.EXE Online Forums, a very popular place for the discussion of Rockman.EXE anime, manga, and games. One of the mods, Core Xion, reported an MSN group hotlinking to a bunch of sprites from REOF users, and encouraged everyone to report all stolen sprites in a respectful manner. Then, big surprise, there's more than a bunch of hotlinked sprites; some users spot stolen fanart, wallpapers, info... the whole site itself is made out of stolen material.

Obviously, everyone wants the group to burn, which leads to a very angry mob that would use torches on the thieves if the internet allowed it. REO's site owner, Ryouko, reports the thievery on REO's update page and encourages everyone to spam away. A lovely piece of wank ensues. While many want to killmaimburndestroy the hotlinkers, there's a small group telling the others to calm down and use their brains before spamming away. Plug-in! Wank.EXE, TRANSMISSION! )

'Apparently' Plagiarism

[info]beccastareyes
Okay, some background. I am a low-ranked fanfiction mod on Mediaminer.org. I don't do much beyond help decide on featured fanfiction, but I do have access to the admin forum. So I got first row seats for a plagiarism wank.

As the [info]fandom_scruples bukkake flows...

ataniell93
Fandom Screwballs has turned off comments and called for a boycott of Nimbus 2005.

"I'm disabling comments to avoid people flaming the authors here, etc."

Bitch, please. Even Diego knows how lame you are, see?

I guess screening comments wasn't enough for them--one of the sensitive souls that make up the community still had to read 'em.

ETA: Lady Maid Marian (isn't she one of our friends at the fallen Gryffindor Tower?) engages in a desperate act of random plagiarism and senseless smut because the Screwballs refuse to take her off their friendslist. (Kiddies, don't click that link. Or if you do, click softly and carry a big spork. She isn't doing this for her pleasure or yours.)

ETA: Fixed the FS link, sorry 'bout that.

[info]pyratejenni
Wasn't there a wank-in-the-making about an allegedly plagiarized theory in the Harry Potter books?

Yeah... there was, because I still have the webpage open in my browser.

ETA: Here's the "You stole this!" post.

I think someone else may have accused them of the same thing, too.

Three time loser.

[info]tabascocat
You folks might remember Gina Demarco (AKA MissLadyVenus) from such wanks as Seperis is a shitty writter and your all fat cows!!!! and No one is allowed to write about gingerbread cookies but me!

She's decided to broaden her horizons, and instead of simply sending poorly-spelled flames, she's now stealing LiveJournal icons.

In fact, most of the content of her two websites has been lifted from wolverineandrogue.com, including screencaps, manipulations, fanart, and even layout images.</a> She didn't even bother to change the file names or anything.

Don't get any bright ideas, though. She's disabled right-clicking on *her* site, because you never know when some dirty thief is gonna come along and steal all your content!
