A law was passed in Washington state (U.S.), making "cyberstalking" illegal, and defining it as thus:

  1. A person is guilty of cyberstalking if he or she, with intent to harass, intimidate, torment, or embarrass any other person, and under circumstances not constituting telephone harassment, makes an electronic communication to such other person or a third party:
    1. Using any lewd, lascivious, indecent, or obscene words, images, or language, or suggesting the commission of any lewd or lascivious act;
    2. Anonymously or repeatedly whether or not conversation occurs; or
    3. Threatening to inflict injury on the person or property of the person called or any member of his or her family or household.
That's right, "embarrass"ing someone is illegal. It can also be to a third party. So, is F_W making more than one post about a wanker count a "stalking"? Or, since we often use "indecent" words (fuckin'-A!), does that count?

Deleted my post after doing some checking. None of the major news websites have anything about this, neither does Chilling Effects.

The only thing wanky here this being posted. If I am wrong please just point me in the direction of a news link with information on this new Wasghton state law.

I think you'd have to prove that the poster was trying to embarrass Ima B. Wanking, of 2345 MsAllegra Street, of Upper Twattington, New Jersey, as opposed to [info]dorkyfangirl. Because on the internet nobody knows you're a dog. You'd have to expose the person's actual real life identity and be trying to embarrass them in some potentially costly way.

Exactly. I am a member of the cybercrime law enforcement community (I don't arrest people, I just giggle over the contents of their hard drives), and in legal terms 'embarrass' does not mean "OMG they were MEEEEEAAAN to me!" It means that you did something to humilate them in some way that affects their real life, not made their net handle look silly.

IIRC he sounded like a really cool politician. The arsehole contacted the employer first, and he either didn't care, laughed it off with the fanfic writer, or both. That's why it got taken to the paper.

I hope so.

I do think that trying to cut down on stuff like cyber-stalking is a good idea.

I've talked to a few people who've had that happen and it can be a scary and frustrating thing because there's not a lot you can do except retire your internet identity and hope the stalker doesn't find your new one.
