Sorry it's a mess, I'm not entirely sure how to lay it out. As far as I can tell, it starts when bubalovelyloves sells a mobile phone. TradeMe goes down four minutes before the auction ends, not counting any possible auto-extend time (ending two minutes after the last bid). davecut is the last high bidder. bubalovelyloves re-lists the auction, after deciding (as far as I can tell) that having an auction that doesn't actually last as long as it said it would isn't getting what you paid for. davecut is Very Very Indignant, and posts many, many comments on the auction. YOU ARE ENTERING AN OTHER ILLEGAL AUCTION, AS A SELLER YOU CAN NOT DO THIS,,, YOU WILL BE BANDED FROM TRADE ME! I am the sucessfully bider on this item , and purchased it , last night on a open public auction after it had reached the reserve. I suggest NO one to bid on this auction as this seller is holding an IllEGAL AUCTION! bubalovelyloves responds to all of them (they're in a question and answer format). People come to davecut's defence, and the TradeMe Terms and Conditions are quoted (specifically, the "service is provided as is" part), in response bubalovelyloves trumps them with the Fair Trading Act and the Consumer Guarantees Act. Seems pretty clear you are wrong. These are the terms and conditions you agreed to when you listed this the first time. I'm afraid the FTA and CGA begs to differ. I am paying for a service in within NZ and I challenge those disclaimers. TM can have all the disclaimers they want but they must abide by NZ law. If turners auctioneers can't hit the hammer whenever they please, neither can TM. People come to the defence of bubalovelyloves. Somebody "accidentally" bids $900. And it goes on. Crazy times. davecut posts on the TradeMe message boards, with the subject "What is fair trading?" People are not particularly indignant on davecut's behalf. Give up. You did NOT win this phone fair and square. Making a complete nuisance of yourself isn't going to change that. And then bubalovelyloves turns up and has a couple of posts, too. 15. Get real people! I joined T .M to have a lot of fun and met alot of good people which I have done. I have always respected the terms and conditions of this system.I have sold and bought alot of items and have a 100% record.The auction I bidded on closed and I was the higgest bidder. My interpretation of it is that "the foundations of our contract (sale of the phone) are conditioned to that the services which the agent acting on my behalf (TM) are fulfilled fairly (based on CGA)." I too believe in far honest trading, that's why I have CHOSEN to relist the phone. Not sure how I have shot myself in the foot, and have absolutely no idea what you mean by love and peace. What matters is that davecut is... delightfully incoherent. He even remembered to give feedback: I WON THIS ITEM ON A OPEN PUBLIC AUCTION. HOW EVER THE SELLER NOW IS RELISTING THE ITEM, THIS IS DIS HONNEST. FIRISTLY THIS TRADER IS NOT TO BE TRUSTED. SECONDLY TRADE ME IS SPONSORING HER BY ALLOWING HER TO SELL MY ITEM ,,, IN EFFECT A "STOLEN" ITEM. NOT ONLY THAT BUT THEY ARE RECEIVING FUNDS FROM THAT SALE WHICH IS AGAIN SPONSORING A DIS HONEST SELLER. I WILL PROCEED WITH FURTHER LEGAL ACTION TO SEE THIS DOES NOT HAPPEN. trader responded: I am unsure why dave had posted this negative feedback against me. TM was experiencing problems during the closing minutes of my auction. I have contacted TM and have relisted because it was unfair to sell when people were unable to bid!
