LJ Abuse vs Boob Nazis
[info]cali4niachef is informed by LJ Abuse her default icon is inappropriate and to cease using it by the 23rd or face having her account suspended.

Boob Nazis. LJ Abuse. Breastfeeding Icons.

I think we can all see where this is going. ([info]booju_mooju first of all it seems.)

Once the anti-breastfeeding comms get hold of this it should really take off.

For legal reasons, LiveJournal Abuse doesn't police the site. They only act on reports. If someone is using an obscene icon, the most likely explanation is that no one has bothered to report them, not that LJ Abuse is a member of a Sekrit Conspiracy against breastfeeding activists.

That's why you see people whose internet lives are full of drama are more likely to end up on the wrong end of LJ Abuse, even though they're only breaking the same rule everyone does.

Go ahead and report someone's obscene default icon and see what happens. (Note: This only works with *default* icons. People can post in comms with non-default icons, and I really have no idea what LJ Abuse's policy is regarding that.)

Speaking here as someone who has seen the rise and fall of popular online gathering places, the problem comes when "not policing the site for legal reasons" coupled with ambiguous TOS regulations and volunteers making decisions about banning for TOS violations leads to a perception of unfareness and thence to customer dissatisfaction.

Which, you know, F_W itself is an example of.

I don't really care about your opinions on LJ Abuse, although I will say that LJ Abuse could be perfect and it would still be surrounded by tons of wank and controversy.

I was explaining why some people are smacked for inappropriate default icons and why others aren't. That's it.

I have no bitch with LJ abuse as a thing-in-itself; I'm just saying that my observation indicates that that form of moderation is prone to disasterous failure.

What 'legal reasons' could LJ have for not policing the site? I can see it being a practical problem--LJ's just too big to check each and every member's default icon on a regular basis--but I don't get how that's a legal issue.

I think it has to do with the assumption of responsibility; it LJ says it actively enforces its TOS, and then someone makes a violation of TOS that's also a violation of law somewhere (say, for example, Australia's take on written porn) then LJ is liable for prosecution by that government.

It was a long time ago that I read about this, so I don't remember the technicals. Basically, by policing the site rather than just acting on reports, LJ would be assuming more legal responsibility for the site's content than they can handle. They could get into trouble for hosting illegal content, for example.

If you want specifics, try emailing them.
