Visa!wank
[info]infrogpajamas posts to [info]pittsburgh telling the community how she "stuck it to the man," refusing to make a purchase at a local bookstore after they informed her of their "minimum purchase" policy.

When I went to check out, my total was 6.48.

The woman would not let me use my bank card or credit card, stating she had a "minimum purchase" of 10 dollars, but prefers 15.

I informed her I would be calling Visa to let them know because it's against their contracted agreement. Any merchant who accepts Visa is contracted to abide by their Terms of Service (I know b/c my family owns a business and I've talked with them about this before). It states very clearly in the TOS that merchants are not allowed to do this.

Here's what Visa says about it:
Minimum Purchase

Visa merchants are not permitted to establish minimum transaction amounts, even on sale items. They also are not permitted to charge you a fee when you want to use your Visa card.

If you run into a problem like this with a merchant, please notify the financial institution that issued you your Visa card. These institutions have access to the appropriate Visa rules and regulations and can help you document and file your complaint. You'll find their address and/or telephone number on your Visa statement. Their telephone number may also appear on the back of the card itself.

Anyways, I emailed the owner about this when I got home, and they haven't responded. I called and the woman who answered hung up on me.

I have made the complaint through my card issuer, and now have a number to call Visa corporate to speak with a representative there. They said that if they get any more complaints that the bookshop can lose its merchant processing contract, etc.

Now I'm feeling somewhat guilty about causing trouble, but I'm also still really salty about the situation because I don't carry cash and I really wanted those books. The woman was rude to me, and I don't think I'll ever go back there, but I still feel like doing something.

That experience totally ruined my entire day in the city, even though I ended up eating at Girasole and had an otherwise OK day.

Anyone else ever have a bad experience like this? Anyone know of other places that charge minumum purchases for credit cards? I think I'd rather just avoid this kind of situation in the future altogether.

"The customer is always right" was a slogan for a chain store in the UK. I have no idea how it turned into a mantra for asshats who think they should be able to do whatever they like and still get their way.

The whole 'I don't carry cash' thing is the most WORTHLESS idea I've ever heard of. I'm a fan of the card swipe myself, but I always make sure I have at leat a twenty on me for that kind of situation. What would she have done if they didn't take cards at all? Or ended up in a situation where she HAS to pay (ie gas station, emergency, whatever) and there's nothing to take a card.

I work for an independent coffee shop that accepts credit cards. I couldn't count how many people come through and charge $1.00, $1.50, and other small amounts every day. It takes forever to run their card (holding up the line) and it costs the business money it really can't afford.

Plus, people who don't carry cash don't tip.

It seems like the commenters have a really good point: she says she wants to support these independent stores, but chooses a method of payment that seriously cuts into their profits and then gets all pissy and rats them out to Visa when they try to protect themselves.

Sounds pretty much like an entitlement whore, to me.

Bonus wank on this very subject: here's what happened when an ice-cream chain in my home town insisted on a minimum credit card charge. Scroll down to the bottom and work your way back up.

Even the owner of the chain gets into it. Fun times.

You know, I understand all the people who are protesting that the OP is tattling on a struggling independent shop . . .

. . . but the fact remains that the shop is violating the rules of their VISA agreement. If they can't afford the charges, they shouldn't accept credit cards, full stop. Being the "little guy" shouldn't give you any more license to break the rules than being the big guy.

I seem to remember being in a kind of inverse version of this situation. Whilst in college at least, I wouldn't use a card at all and so when I did go to a bookstore, I paid in cash and always struggled to keep purchases within £10 (or otherwise take a trip to the ATM and smite my bank account verily).

Anyways, I get where the OP is coming from and I appreciate that the little guy is breaking the (completely crappy) rules set by Visa sentences like this:

really don't endear me to the OP very much. The profits bookstores can make on books can infact be pitiful in a lot of cases, especially when they are smaller stores unable to make huge orders from distributors and publishers so yeah, there is a good chance that would have infact been a rather hefty chunk of their profits

I know several places (mostly gas stations) that have minimum purchace requirements for credit/debit cards. I wasn't aware that Visa had rules against it; but it makes sense, since such a thing cuts into their profit margin... Both sides have valid points, actually.

That being said, the OP needs to put on her big girl panties and deal with it. Hit the ATM or look elsewhere.

I know it must be annoying for a lot of clerks but it's SO a thing I would do. I am not wealthy so if I fucking want to put 5$ on my credit card, you slide it in fucking machine and suck it up. What are they complaining about? They are getting money.

I actually know quite a few businesses that can get in trouble for that now. :-/ It is annoying to run into situations like that (especially when they magically decide to change their policies after years of practice otherwise), but given some of the fees businesses get slammed with for running cards, I can't help with empathize with why it's done.

Good fucking god, what's with all the people here prattling about VISA's TOS and the agreement and blah blah blah? Fuck VISA, you think they're some benevolent organization? They're out to get as much money as they can, and it puts places like independent bookstores in a shitty, shitty situation.

I agree with the OP if that is Visa's policy. If stores don't want to follow the rules then it's their own fault if someone who actually knows the rules calls them on it. It's as simple as that. They are depending on the ignorance of the customer to not get in trouble. That irks me.

I carry cash - I like to at least have $40 in cash in my wallet, just in case and for tips. Hell, I even still have a checkbook in my wallet. But if I'm shopping, I always automatically had over the credit/debit card, and if they ask I always run the thing as debit. It's just so much incredibly easier that way.

Interesting enough, I somehow had no idea that Visa (and I'm assuming other credit card companies) charge steep enough transaction fees that using a credit card for small purchases can be detrimental to a business's profit margin. I'm not going to take sides in the arguments, since they both have valid points, but I am going to walk away from this with a better idea of when I should forego using my credit card.

Also, I don't suppose it's against Visa's TOS for a company to put up a sign saying, "We would appreciate it if you could use cash for purchases under $10?"

Mmm all of it is wanky. And this is where people like me sit up and say "There is a solution! Fear not! Simply pay with cash!"

Meaning --and I know there are going to be cries of "You're joking right?! DARK AGES!"-- that I don't have a debit card. I don't have a credit card. If I want something? I must pay in cash. I don't have debt to pay except monthly bills. My credit is almost spotless. Can I get a card? Sure. But I don't want to fall into the traps that the interest can cause, and I don't have to worry about not being able to make a payment.

So, cash is the way to go folks!

Honestly, little bookstore and OP both need to suck it up.

Charges suck, I lose almost $1.50 a transaction for the privilege of being able to accept credit cards, but I deal with it, because that was in the contract that I agreed to. The credit card company takes all the hassle out of collecting checks or money orders from my customers and I pay for that service.

On the other hand, I would have just walked out of the store if I didn't agree with their minimum purchase policy. Well, I would have walked out after informing them that I was never going to spend money in their shop again, and that they probably lost more money by losing my sales than they would have paying the fees.

I love indie stores and avoid chains like the plague, but fuckdammit, people, when did "All mom and pop stores are tiny labors of love run by sainted cheerful elderly folk who are just struggling nobly to make a thin dime" become an accepted trope? Because that shit pisses me off as much as that stupid "customer is always right" garbage. Stores are run by people, some of whom are cool, and some of whom blow.

Also, it'd be way easier to agree with some of what [info]suicideking was saying if not for that icon. Fuck you, civil disobedience rocks.

*shrug* I always report businesses that charge fees to use debit unless a minimum purchase is made, and I don't know why the OP is making such a fuss out of it - making sure that a business is keeping their contracts and not fucking over their customers doesn't make her a rebel against the machine.
