Amazon Wank
So it seems that before Christmas Amazon had a DVD offer on boxsets - buy one get one free. Except they made a bit of a mistake and the lowest item was actually taken off twice. This resulted in, if you had two items of the same price, free DVDs.

As will happen people took advantage of this and people discussed whether that was ethical.

Skip forward to December 28th, and Amazon finally realises their error. All customers affected are asked to either return the boxsets unopened, or their credit cards will be charged the total price.

Aaaaand wank results People ask whether it's legal. Some people ring Amazon to complain. And some people sit proclaiming that it's all perfectly fine and serves folk right for taking advantage of it.

I'm sure that's not legal. If you miss label something then you have to sell it at that price, at least that's what I learned working in retail.

That's what the customers always insist 'somebody told them'. I've looked into it and in Canada at least, it's not true.

It is in Michigan- up to a point.
If something is mis-marked, and the cashier fails to charge you the marked price, you are entitled to a scanning error reward of five times the price difference, award not to exceed five dollars, plus a refund of the price difference.

But then Michigan has some of the strictest pricing laws in the country. Walmart and a bunch of other major retailers would like to see the laws changed so that individual items don't have to be priced at all- just shelf tagged.

This Wank makes me wonder if people ever got their 'free' Narnia box sets from focus on the family or whatever the christian website with the variable donation policy was.

Nope! But I got a Chick Tract catalog and an ad for Exodus, the ex-gay people, so I think it was worth it for the lulz.

It wasn't mislabeled, but thanks for playing!

And Amazon actually has been great about honouring mislabelled products. Everyone who pre-ordered the $80+ Absolute Sandman when it was labelled $14.99 got it for that price. Mind, it might have been a better move to offer those affected x% off their next purchase for the inconvenience - soothe public opinion and still get some extra money off another purchase that might otherwise not have been made.

Not everyone. When they realized their mistake they canceled my Sandman order and offered to re-order it for me at the correct price.

They'll do that if they haven't shipped it and thus charged you. At that point, you've not yet bought it, just requested that they sell it to you.

Ah - cancel my praise for Amazon, then. I was just going by what had been said in Neil Gaiman's blog.

Wait, wait. Do you think when Stargate Atlantis season 1 was being sold for $15 that was a mistake? Because I just thought it was a GREAT deal and I bought one for my brother and one for me.

Ok, sorry. That's what it seemed like from the way the report was written. Amazon made a mistake, people took advantage of that mistake = Amazons fault.

I work in the UK so that might make things different.

Well, the checkout made a mistake. But as fas as I can tell, it was labeled the correct price when you "click(ed) to order".

Semantics R fun!

Thats what I always thought, too. They mistake, their responsibility. I think its pretty crappy to intentionally take advantage, but if it was me, I'd probably think I was getting a warehouse-clearing holiday bonus or something. Especially if the dvd is crappy.

I think that's a customer satisfaction policy, not a legal one.

No, that's not really the case, because that's when you get people switching price tags on things and going, "That $15 dollar bottle of vitamins was totally labeled for $.50 when I found it! ZOMG FALSE ADVERTISING YOU MUST SELL IT TO ME AT THAT PROCE!" And we were always like "yeah . . . nice try, but no."

*nodnod* One clothing store I worked at had sale tickets that basically slid overtop of the regular tags, so it was incredibly easy to take them off and slide them onto a non-sale item. We were basically told to use our common sense - if everything was mistagged, honour it. If this one thing magically wound up mistagged when nothing else did, give 'em the nice try but no.

We used to have people do that too, putting dog toys in the sale and then making a fuss when we said those toys weren't sale items so no, they couldn't have sale price.

But if we legitimately had something marked then we had to sell it at the price it was on the shelf.

Wow, aren't you a sweetheart?

I was kind of asking as an over all, not as an expert. Notice the qualified it with what my knowledge. I'm not an expert but I wanted to know if they could do that because were I work you can't.

But I work in the UK in a pet store so things might be very different. However, I don't know.

Yeah, I know I'm not an expert but thanks for playing!
