ADA Wank, with a side of Mac Vs. PC and Liberal Vs. Conservative!
So, two California women are suing Apple for alleged accessibility violations in its SF retail store. The comments on the article are, needless to say, wanky, with some complaining about the liberal activist agenda, allegations that the women are just out to make a quick buck, and the occasional disabled person chiming in on both sides of the issue.

Also, WTF is a "standing wheelchair?"

I think able-bodied people simply don't realize what, or how many, obstacles there are in a lot of stores and restaurants for people in wheelchairs. It's like fighting a pitched battle every time they want to step out for a burger, ferchrissakes.

The lawsuit by these two women is nothing short of frivolous.

I'll laugh my ass off when their "Allegations" are proven to be false and they no longer have a leg to stand on.......in court that is! ;)


I can't decide if that right there makes me want to cry or kill some one.

I suspect this is another "McDonald's lawsuit" that sounds ridiculous - by that I mean the "emotional and physical damages" - but may be completely understandable and valid the more we know about it.

Yeah, right, re the comment by Rob, the Portland store ignores customers.

For values of "ignores" which includes having a sales person talking to you (listening to you, which is a nice change) within a couple of minutes of coming in the door.

Every Apple Store I've been in seems pretty much ADA compliant, within the usual expectation of a retail enviornment- which does notinclude having every product within unassisted reach of wheelchair users or short people, as long as it's not exclusively self-service.

(OK, I just bought the sixth Mac to come into our houshold, to replace the first one to ever break, an eight year old iMac. I'm pro-Apple).

People who laugh or are otherwise condescending towards people in wheelchairs complaints of poor accessibility in certain places should be condemned to a day in their normal routine, going about in a wheelchair.

You know what? Fuck anyone who thinks this is somehow 'frivolous'. Why shouldn't companies like Apple have to comply? I don't care what grounds the suit was brought on, but it needed to be done.

I love all the Apple Fanboys saying "Oh it's probably a grudge over some product that didn't work". Yeah Bucko, 'cos a busted iPod is worse than having to fight for access to things and places that other people take for granted.

I hate stuff like this. Some simple building modifications is all that it would take to allow some people to be more independent and included, and people without disabilities bitch like having to walk up a ramp or look at modified seating is going to kill them.

There is no fucking reason for the ADA to be enforceable only by lawsuits. It's insane and ridiculous and blatantly contemptuous of the entire *idea* of state-mandated accessibility for the disabled. Oh, sure, we'll pass an Act for you! And as long as you have enormous amounts of money and free time you can totally spend years trying to get someone to abide by it! Unless it's an *old* building, of course, in which case you're fucked. Because old buildings are historically important, and you are not important at all.

I just can't even--*deal* with how incredibly backwards American disability law is, and most people have no clue, and would rather believe that disabled people are just entitled jerks for wanting to leave the house now and then. I mean, what possible *civilized* reason is there for NOT having accessibility laws that you can report people for breaking like any other building code? Especially when disabled people are even less likely than the average person to have the wherewithal for a drawn-out lawsuit at their own expense.

(But of course, it all just reflects the general opinion. God, the LOOKS I've seen people in wheelchairs get when they *dare* to use a public bus with a ramp, thus holding everyone up another precious ninety seconds. As if it were some kind of mass public service or something. HATE HATE HATE HATE.)

I always feel terrible when someone in a wheelchair tries to come into the store I work in. The building itself is accessable, but we have rather too much stuff, so there are boxes and shelves everywhere, making it really hard to navigate in a wheelchair. Last time we had to have one salesperson trail after the guy grabbing stuff for him, trying to make sure he could actually get from section to section, and it just plain sucks that something as mundane as picking up homeschooling materials has to become a major exercise in physics and patience.



Honestly, how much emotional damage do you experience when you can't reach something on the shelf? Do you sit down on the floor and cry until someone reaches the item for you? Do you run off and write slanderous statements on your blog about the mean nasty person who did this to you? Or do you find another way to get the item you want? OOoo....I'll take option number three please!!

As much as I feel for them, I'm having a lot of trouble believing that the Apple store wouldn't comply with the rules. They use about the same design for all of their stores, the idea that they wouldn't check to make sure it was good before spending a shit load of money building the stores is mind boggling.

I hope their aim is to make the rules more reasonable. I'm not disabled, but I bet that would make more stores that I don't have to do ninja moves to navigate through.

I think it's ridiculous, myself. The solution to every problem in the world is not to sue people, and their claim - "emotional and physical losses" - has no basis. What physical losses? Did they lose money or personal possessions? No. Were they physically harmed in some way by difficulties with access? No. And "emotional losses" is, I would venture to say, frivolous in the vast majority of lawsuits, and what you sue for when you realize you really don't have a case on anything else - or when you want to tack on a bit of extra money.

Stuff's out of your reach? Ask someone to get it for you. Can't get into the theater for instructional workshops? Get an employee to show you how to use something. If the barriers are insurmountably serious, talk or write to management. The culture of lawsuit-as-first-resort is just silly.

When I was in SF (about two months ago) there was an article about this disability lawyer who represents people when stores aren't ADA compliant. One of his clients sued three or four restaurants in one day. Apparently this lawyer is making biiiiig bucks and store owners all over SF are coughing up to avoid going to court. Wish I remember his name :(

I must admit that back in my stroller pushing days I was thankful many, many times a day for all the wheel chair access laws. It's amazing how you start to pay attention to things like curb cuts when it actually impacts you. Before then it never even occurred to me how wide an isle in the store was. Of course, all I had to do to solve the problem for myself was park the stroller and carry the kid, so I couldn't really bitch too much when I went somewhere that violated those laws. (except that I did bitch, and bitch mightily)

On this, I can say for a fact that Apple is trying just as hard to be trendy in Oregon -- lot's of chest level tables.

Maybe it's just me but after my time working at AOL and how without so much as a 'huh?' really went the distance to accommodate the disabled with things such as the voice rec software to special monitors and ramps, not to mention beds with the company logo for helper animals and 'walkies' staff on hand, I just don't see how it's an issue to make accommodations for those who need it.

I'd imagine it's more cost effective in the long run to ensure things are accessible and a little extra training to staff on things than having things escalate to the point of lawsuit.
