I actually suspect that the name was a desperate attempt to come up with something that would get through the non-profit process. It's unwieldy and weird -- I'd never really heard the term "transformative works" bandied about until they started using it -- but knowing a bit about the 501(c)(3) applications process, I suspect they needed a serious, academic-sounding name to have a chance at approval.
