California high court upholds gay marriage ban, says prior unions still valid.

At least they didn't retroactively annul? But still... 'scuze me for a second, gotta go beat my head against a wall.

At least there's Justice Moreno:

"In my view, the aim of Proposition 8 and all similar initiative measures that seek to alter the California Constitution to deny a fundamental right to a group that has historically been subject to discrimination on the basis of a suspect classification, violates the essence of the equal protection clause of the California Constitution and fundamentally alters its scope and meaning."

I agree--but what worries me is my husband's assertion that because of the equal protection clause, it's very likely that the unions that weren't declared null and void today might be later on. :C

I was in class when they released the decision so I had a friend text me with the outcome, and then had to sit through two hours of Latin quietly fuming and yearning for my megaphone and angry-protesty-boots. Am donning both now; this fight is NOT over, goddammit.

At this point, I'm holding out hope for a HUGE voting push for next year's ballot. I say fix this situation in the "right" way--get Prop 8 removed in the same way it was installed.

Prop 8 won by 52% of the vote. I think as people see the New England states and Iowa thriving with gay marriage, some of those on the fence will back off.

I don't agree with what the court's done, but I also think that their hands were somewhat tied by the way the California Constitution is written. For what it's worth, if gay marriage were being enshrined in the constitution as legal through a simply majority vote, we'd want that upheld by the court, and I think they'd uphold it, b/c they're stuck with a narrow legal argument here.

Doesn't mean I agree. I absolutely don't. But it's not over. And thank GOD they didn't apply it retroactively (which, wouldn't that be against the US Constitution, anyway? No ex post facto laws?).

I'm sad but not really shocked that the Supreme Court upheld the ban. But like [info]snarkhunter said, this isn't over. Far from it.

We'll get it overturned eventually. Still, I'm very disappointed in my state right now. In 1948, we were the first state to legalize interracial marriages, and I was rather hoping that we would continue in that noble tradition.

As tempting as it is to move to the east coast, I'd rather stay here and fight the good fight. I'm not going to let the fundies have my state.

On the plus side, this article estimates that same-sex marriage will be legal in all 50 states within 15 years.

I'm disappointed but not necessarily surprised. I'm very happy the queer community at my school is doing so much ins response to it and that it'll inspire a lot of signatures to put a measure on the ballot to overturn Prop 8 at least.

Okay, they want the title of marriage to be sacred and holy (just like in Deut 22:28-9)? Fine with me - let's make religious unions "marriages", and call that form that everybody has to sign down at the county clerk's office something else. Joining. Union. Hell, call it Fred, so long as everyone gets the same treatment.

I know this sucks, but complaining online is about as effective as well complaining on the internets. There will be a ballot referendum to repeal Prop 8 in 2010 and people need to start organizing now.

The Courage Campaign is raising money to broadcast ads in favor of gay marriage. http://www.couragecampaign.org/

Equality California wants to set up campaign offices in areas that voted yes on 8 for a new election in 2010. http://www.eqca.org/

And yet. I think Prop 8 will historically turn out to be a massive Pyrrhic victory for the haters and KKKhristians (like there's a difference).

Look at the states that galvanized their own marriage equality laws after Prop 8 won -- fuckin' IOWA saw what CA did and how wrong it was, and the Lege overruled the governor's veto to legalize it. Took how many years for two states to legalize gay marriage? Took a week for the next two to do so.

The dominoes fall. The haters are old and very soon will be outnumbered.

Wow, that sucks.

But speaking from the experience in Norway - we got same-sex unions about 15 years ago and a lot of people were a bit uncomfortable about it at the time. Time passed, and our country didn't collapse, got eaten by locus or struck down by lightning. Nothing much changed. People got used to having it. New generation grew up with it as a fact. The precentage of people in support of it grew slowly and steadily. This year we got gender neutral marriage and that was backed by a majority.

Those who screamingly and hysterically against it, those you'll always have. But I'm pretty sure a lot of people will change their mind.
