California high court upholds gay marriage ban, says prior unions still valid.

At least they didn't retroactively annul? But still... 'scuze me for a second, gotta go beat my head against a wall.

At least there's Justice Moreno:

"In my view, the aim of Proposition 8 and all similar initiative measures that seek to alter the California Constitution to deny a fundamental right to a group that has historically been subject to discrimination on the basis of a suspect classification, violates the essence of the equal protection clause of the California Constitution and fundamentally alters its scope and meaning."

I agree--but what worries me is my husband's assertion that because of the equal protection clause, it's very likely that the unions that weren't declared null and void today might be later on. :C

There will certainly be lawsuits. As well as other lawsuits insisting that the equal protection clause no longer applies to non-heterosexuals at all.

I'm hearing the opposite. Ted Olson and Scott Baio (yeah, from opposing sides in Bush v. Gore. Hardcore, right?) brought up a federal lawsuit to nullify Prop 8 on the basis of the Equal Protection Clause.
