Personhood Amendment in Mississippi: Insanity Will Ensue.
MS Amendment 26 proposes that the rights of a person will be protected from the moment of fertilization.

Be it Enacted by the People of the State of Mississippi: SECTION 1. Article III of the constitution of the state of Mississippi is hearby amended BY THE ADDITION OF A NEW SECTION TO READ: Section 33. Person defined. As used in this Article III of the state constitution, "The term 'person' or 'persons' shall include every human being from the moment of fertilization, cloning or the functional equivalent thereof." This initiative shall not require any additional revenue for implementation.

26 is being promoted by The Conceived in Rape Tour in an effort to educate people about the evils of abortion.

If it's any consolation, we in Colorado keep having the same thing pop up every election cycle, and every time it gets SOUNDLY defeated. We are a mostly purplish state, too.

Okay, being from MS:

1. It's not law yet; it's on the ballot in Nov.
2. It's already being challenged in the state Supreme Court, which hasn't ruled yet (that I know of), so there's still a chance it might not be on the ballot.
3. We're not the first state this has been tried in; several other states have active movements to do this.

That said, if it's on the ballot, yes it will probably pass in this state. Even candidates for governor are supporting it. That's because they all think they're being sneaky and getting around Roe to end abortions forever! Forget the little matter of federal constitutional law superseding state law. For that reason, I don't think it'll hold up under federal scrutiny.

But let's set aside the abortion part. I don't care if you think abortion should be illegal, there's lots of reasons this law is bad. It prevents certain types of birth control (like IUDS, which prevent implantation, not fertilization). Are women with IUDS going to be charged with attempted murder? Are doctors that provide them? There's the matter of being unable to treat women with ectopic pregnancies - because treatment is, essentially, an abortion. It criminalizes miscarriges. Every miscarriage will have to be investigated they same way any mysterious death would be. Autopsies, etc. Women have to constantly act with the presumption that they're pregant. Drink a beer the day before you find out you're pregnant? you've committed an assault. go on a roller-coaster? Same thing. And then,there's artificial reproduction. IVF wouldn't be practical. Parents would be financially responsible for excess embryos indefinitely - you couldn't destroy them. You'd essentially have to pay child support (in the form of storage costs). I guess you could terminate your parental rights; since they're people now, would court protections attach, requiring a hearing? And if they can't be destroyed, does the state take custody of them?

I think this is a bad law for so many reasons that have nothing to do with abortion. It's essentially a female behavior control law and it's stupid.

Conceived in rape and targeted for abortion, Rebecca [Kiessling]will explain why Mississippi voters should vote "Yes" on Amendment 26..."I do hope that, as a child of rape, I can help to put a face, a voice, and a story to this issue."

While I don't want to dismiss what is obviously a deeply personal issue for her, I feel like Kiessling's story isn't as important to this issue as the stories of people like her mother. Her mother, after all, is the one who was raped, had to make that decision, and is living with the ramifications.

Then again, these people don't seem to be reaching out to rape survivors who are deciding whether or not to abort; no, they're just riling up the voters with stories of people who were "targeted fro abortion" (frankly, I'm surprised the phrase "abortion survivor" hasn't come up yet).

Apropos of very little, I went to the Museum of Natural History in the Smithsonian recently and their exhibits on prehistoric organisms and whatnot ALL include a mention of evolution. Sometimes there are even neato videos showing you how an animal may have evolved to its present form. And it's conspicuously everywhere, as if they're saying "NO REALLY, EVOLUTION. LIKE, FOR REAL. IT EXISTS." And it made me happy, especially to imagine all the horrified fundies clapping their hands over their children's eyes, because what do those hacks at the Smithsonian know, anyway?

Said all that to avoid an aneurysm say this: SCIENCE, MOTHERFUCKERS. LEARN YOU SOME.
