Potter for Profit? Maybe!
Is selling your fanfiction at $80 dollars per book bad? Especially when the entire hardback 6 volume original series is only $20 more? Apparently, not if you are a Harry/Ginny shipper.



So, the backstory. Over here a prominent Harry/Ginny fanfiction author has a series of Harry Potter fanfiction novels for sale. The prices seem rather high--the lowest of them is $50.00 for a single book. Particularly when other novel-length fanfictions on the same site are a quarter or half the cost. Additionally, there is an audio book partially available as well, though apparently it's free.

There's been a recent upsurge in posts on F_W regarding fanfiction being sold. In this one, a poster makes a comment pointing out that not only in the Star Wars fandom does this happen, but also the aforementioned Harry/Ginny shipper has done it as well. The first few posters agree it's a bit ridiculous. But then the H/G author herself shows up and claims that it's not copyright infringement to be selling her fanfiction for large sums of money. I guess the reason why is that, allegedly, she makes no money off the deal, so it's a-ok to do this. It's also allegedly a "zine" in theory, though I've not heard of any $80 zines lately, and as far as I know most zines tend to have more than one story and different authors in them.

Needless to say, people who ridicule Harmonians for just about anything show up in droves to defend this author's right to charge very large sums of money for her fanfiction. I guess if a known H/Hr shipper points it out, it cannot be wanky (a H/Hr shipper noticing wank makes it nonwanky? Who knew?), or it's the H/Hr shippers fault for pointing it out. Even mice cannot comment without being lambasted. It's good to know you can sell your fanfiction all you want and for 4 times the price of a regular book as long as you call it a "zine". It's not copyright infringement then, I suppose.

I have here a 200 page fanfic, er, "zine". I'll charge $45 dollars "for publication costs." Any takers?


ETA:While the author of the fanfic has denied making money on this deal, another zine publisher states that they have dealt with the same publisher, and that at these prices, profit is happening, and most likely by the author, since the publisher only takes a commission. Unless directed elsewhere, the author gets the rest of the profit.

ETA II: Apparently, the fanfic author has some correspondence online with the site in question.

I still just don't get that part. I mean, I can accept that everyone is telling the truth and that it's just for printing costs, but it seems like an awful lot. My one (lame) explanation is that it's to keep people from actually buying it, so the lawyers don't get involved. And that's a really lame explanation.

$80 seems ridiculous--I think the most I ever paid for a zine was about $25, and it was huge. But:

as far as I know most zines tend to have more than one story and different authors in them.

The single-author, novel-length zine is not at all unheard-of, just like novel-length fanfic isn't unheard of on the Internet.

I really don't give a crap about pairings, shipping and I think adding the 'who ships what' is distracting from the point and makes it sound like grudge-wank.

That being said, I really cannot see the difference in some woman selling her Star Wars Fanfic, calling the fic a 'book', and some other woman selling her Harry Potter fanfic, and calling it a 'zine'. Same difference; it's making money off Fanfics and has as far as I've seen been called a big fandom no-no. (Yes, yes, I know in the good old days fanfics got around through zines. Fandoms everywhere owes a lot to zines.)

And the pile-up of "It's different because the site slapped on a 'IT'S A ZINE' sign" was just wanky.

(Goddammit, I need a towel now *mops up spooge*)

So wait a sec here. First of all, wank reports with an unabashed agenda are annoying. See this post.

Secondly, I don't think this belongs in [info]wankitywank. I would say take it to the Cornfield, but I'm not sure it fits there either. In fact, I'm pretty sure it doesn't fit anywhere, because we don't have any communities for bitter shit-stirring chipped-shoulder shippers (say that 10 times fast).

Personally, I think selling ANYTHING fandom related nowadays (as in, it uses the names on the characters and the name of the show) is risky but whatever. At this this 'zine' stuff isn't on Amazon so it's a little harder to find if, in fact, it is a copyright violation.

The reason you're getting a different reaction from most is that you haven't learned the trick of reporting wank in a way that doesn't make it sound grudgy. I don't know if you even have a grudge toward this particular person, but it certainly sounds like it. In fact, it's making it sound way more grudgy than it probably is.

Is that really a prominent H/G fanfic author? The reason I ask is I quite enjoy a good H/G fanfic and not only have I not heard of this series, I have never heard of the author (and trust me, I waste more then my fair share of time surfing for HP stuff).

I thought that if you don't get what you paid for you have to give money back if the customer wants it?

Although I think the fact that this person is a "prominent Harry/Ginny shipper" has little-to-nothing to do with it, I do think selling fanfiction is both sleazy and illegal.

It doesn't matter how much it costs to print--the right to make a profit off the characters and plots belongs exclusively to JK Rowling, and rightly so. Fanfiction is harmless fun, but when we forget that it was JK Rowling who invented the series and the stories and went to the trouble of getting her books published and start profiteering off her creation--that's not cool. Legally or morally/ethically/whatever code you live by.

Unfortunately, the fact that Vanceone can't keep his shipping agenda out of it turns a rather important issue into yet another Harmoanian-versus-the-world farce.

You know I sort of agree with you. Charging $80 for a zine it's sort of too expensive (I remember paying $15-25 back in the days when I didn't have a computer. Plus they had pretty pictures) and it's difficult to believe no one is making profit out of it. However, the author has everything in the net, available for free (just downloaded the PDF to see what the fuss was all about.)

But, you've managed to make yourself sound so damn grudgewanky again that it's difficult to see your point. If you're so bitter about all the harmonian wank going on and want to stop getting reported, just stop wanking and get over it or at least have the intelligence to keep the juiciest stuff locked. That way, everyone wins. Well, everyone but us who love to see teh funny.

You weren't told to STFU because an harmonian reported it, but because you tried to make it all about the author being a H/G 'shipper' rather than the, IMHO, exorbitant costs of the fanzine-

That said, if [info]white_serpent or fabula rasa made their stories printed and available for the masses in a pretty format, I would most definitely buy it, if the prices are reasonable, copyright be damned

Firstly, I'm not an H/G shipper.

Secondly, I brought the matter to Barb's attention because it was a serious accusation and should have been brought to her attention in the first place.

And thirdly, I'm mixed on the issue. Zines do have a long and honourable tradition, but I think they've always been in the grey area like fanfic itself sometimes, and with the internet, the necessity for them has gone down, so that authors may look less kindly on them. But that said, I've nothing against them on principle. And as I noted, some of my favourite authors got their starts in zines.

Fourthly, I wonder if anyone's paid all that money for the fic. I can't imagine they have, honestly.

A few things I'm wondering about....
1. Why is everyone insisting publising a fanfic as zin is far less terrible than to have it on Amazon? There at least its 40 Dollar cheaper and you get a far nicer quality.

2. Who gets the money if not the author? It's bit strange that only her fanfics are that expensive...probably better writing, more money?

... It comes down to FanFiction is a grey area in law and an author can't really be sued as long as they have no profite out of it and even then you can get away.

The grudge bit has been covered to death. As has the part where we point and laugh at someone who thinks $80 "zine" of fanfiction does not equal copywrite infringement. It's apochryphal! ha ha!

But I'm still confused.

Why is this in wankitywank? I thought this was where we laughed at wankas who turned into wankers in the midst of a generally scheduled mocking on F_W, OTF, Hp_cornfield, i_wank, etc.

This should have been HP_cornfield material (dealing as it does with the horrors of shipping), heck, it could have been F_W material given that Star Wars thing last week. If vanceone posted in the wank him/her self, it should have been i_wank.

Call me a stickler for details, but I like my wank appropriately organized.

A zine publisher says a 300 pages zines with color ilustrations shouldn't be above 30 dollars in cost, plus s/he clarifies that Agent with Style indeed does pay a comission to the author of the published fanfics!

ETA:While the author of the fanfic has denied making money on this deal, another zine publisher states that they have dealt with the same publisher, and that at these prices, profit is happening, and most likely by the author, since the publisher only takes a commission. Unless directed elsewhere, the author gets the rest of the profit.

Vance, get the facts stated in the links right.

However, to clarify, Agent With Style is a zine distributor --yes, she publishes her own zines -- but mostly she agents for other zine publishers. She takes a commission for her work. (And no, I am neither for or against this practice, just stating a fact.)

The publisher pays the commission. So, if Barb is the publisher as well as the author, then she is in line for getting the profits. However, if the publisher who commissioned the zines isn't Barb, then she is in all likelihood telling the truth. So, unless you have a paper trail for us, try to be a bit more balanced, K?

Wait, does this : Also, in spite of the fact that I knew I had readers on the lists who might want physical copies, I was NOT feeling inclined to be particularly cooperative with her. I never allowed anything to be posted on the lists concerning this, figuring that if people found her website that was one thing, and she could unload what she'd paid to have printed, but I had already not had any contact with her for almost a year, she absolutely did NOT do what she said she'd do (send me files I could see before printing) and didn't really want to have anything else to do with her.

Whoops, she edited that site as well. Looks like someone tries to cover something up here, very strange.

No. No, no, no, no, and no. Actual parody is protected by law, though it won't stop a copyright holder from taking you to court if s/he feels the parody is too close to the original material (see The Wind Done Gone). It's why few people try to sue Mad or Saturday Night Live.

Fan fiction is (generally) pastiche, not parody, and until there's some sort of court decision that says otherwise (don't hold your breath), it enjoys no legal protection. Barry Trotter and the Unauthorized Parody and Movies in 15 Minutes are parody. Harry Potter and the Psychic Serpent is not.
